A PETITION TO THE WEST ORANGE TOWN COUNCIL

We, the people of West Orange, New Jersey, condemn the murders of George Floyd, Tony McDade, and Breonna Taylor, caused by the systemic failure of policing.

In light of racial injustice across the nation, we desire to take reasonable and tangible proactive action at the municipal level to ensure that such a tragedy will never occur in our multiethnic community.

While our town's use of force statistics are not the worst in the state, we still have a long way to go.

Based on population, a black person is 173% more likely to have force used on them than a white person. Based on arrests, a black person is 29% more likely to have force used on them than a white person. (source) These numbers must fall to zero in order for justice to be served.

Today, June 6th 2020, we approach Town Hall in Peace to civilly demand the following:

  1. THAT THE TOWN PASS A LOCAL ORDINANCE BANNING THE USE OF KNEE AND CHOKE HOLDS BY POLICE.
         Because this unnecessary use of force has the potential to asphyxiate and kill its victims.
  2. THAT THE TOWN PASS A LOCAL ORDINANCE BANNING THE USE OF TEAR GAS ON CROWDS.
         Because tear gas has been banned in international conflict since 1993 by the Chemical Weapons Convention.
  3. THAT THE TOWN COUNCIL PASS A LOCAL ORDINANCE BANNING THE USE OF RUBBER BULLETS ON CROWDS.
         Because rubber bullets are unnecessarily harmful and can cause death.
  4. THAT THE TOWN COUNCIL PASS A LOCAL ORDINANCE REQUIRING A BODY CAM ON ALL ACTIVE DUTY WEST ORANGE POLICE OFFICERS ON PATROL.
         To ensure transparency and accountability in policing.
  5. THAT THE TOWN COUNCIL REVISE OR REPEAL §4-12.2 B OF THE MUNICIPAL CODE, WHICH READS:
     “No person shall loiter in a public place in such a manner as to create or cause to be created any disturbance or annoyance to the comfort and repose of any person, provided that the disturbance or annoyance would be a disturbance or annoyance to the comfort and repose of a reasonable person.”
        Because the subjective language of this ordinance enables racial profiling.
  6. THAT THE TOWN COUNCIL PASS A LOCAL ORDINANCE ESTABLISHING AN INDEPENDENT CIVILIAN REVIEW BOARD CONSISTING OF COMMUNITY MEMBERS THAT HAS THE FOLLOWING POWERS:
         a. Make recommendations and suggestions about police protocol to the town council and police department.
         b. Review and make suggestions to alter the existing use-of-force continuum.
         c. Oversee internal affairs investigations.
         d. Receive and investigate complaints of excessive force, abuse of power, obstruction of justice, and racial profiling.
         e. To have discretion over the publication of body cam video in the aftermath of a heinous case of police injustice occurring in West Orange.
         f. Issue subpoenas.
         g. Participate in police union contract renegotiation.
         h. At least one member of the board must be a youth representative under the age of 18.
  7. THAT THE TOWN COUNCIL, MAYOR, & CHIEF OF POLICE SIGN A COMMITMENT TO ACTIVELY COMBAT RACIAL INJUSTICE WHILE CARRYING OUT THEIR DUTIES OF OFFICE.
