To the California State Legislature:

We, the undersigned fire survivors, residents, property owners, businesses, and organizations of Altadena, write in support of SB 1090 (Pérez).

SB 1090 places a conservative, 3-year pause on the by-right, ministerial approval of the infill housing mandate created under SB 1123 — a law that allows a qualifying property to be subdivided into up to 10 parcels and was never intended to be applied in a town devastated by a wildfire. Every identified user of that pathway since the Eaton Fire has been an outside investor, not a returning Altadena family.

Altadena deserves the same protection as the Palisades. SB 1090 closes a gap in how CalFire's fire-hazard map treats two communities that suffered the same devastation. Pacific Palisades is exempted from SB 1123 because it almost entirely sits inside a Very High/High Fire Hazard Severity Zone. But Altadena's burn area sits mostly outside those CalFire-designated zones, thus leaving Altadena exposed to efforts from outside predatory developers. SB 1090 addresses this disparate treatment under the law.

Meanwhile, SB 1090 takes nothing away from homeowners, owner-occupants, or providers of affordable housing. Survivors keep their like-for-like rebuild rights, ADU rights, and duplex/lot-split options under SB 9. This pause targets only speculative multi-unit subdivision under SB 1123 — nothing more.

This is temporary, targeted relief for a community in genuine crisis — not a permanent rollback of state housing policy. We ask you to vote AYE on SB 1090.
