We, the undersigned, are writing to express our concern regarding the criminalization of homosexuality in Bangladesh under Section 377 of the Bangladesh Penal Code. We believe that this section is discriminatory and violates the human rights of individuals who identify as lesbian, gay, bisexual, transgender, and queer (LGBTQ+).

আমরা নিম্নস্বাক্ষরকারী ব্যক্তিবর্গ বাংলাদেশে প্রচলিত দন্ডবিধির ৩৭৭ ধারায় সমকামিতাকে অপরাধিকরণ করায় আমাদের গভীর উদ্বেগ প্রকাশ করে আপনার সমীপে নিবেদন করছি যে, আইনের উক্ত ধারাটি বৈষম্যমূলক এবং বাংলাদেশে বসবাসরত সমকামী (নারী ও পুরুষ), উভকামী, রুপান্তরকামী এবং কুইয়ার (অর্থাৎ সকল যৌন প্রবৃত্তিগত সংখ্যালঘু) হিসাবে আত্বস্বীকৃত ব্যক্তিদের মানবাধিকার লঙ্ঘন করে। কারণ, গণপ্রজাতন্ত্রী বাংলাদেশ সংবিধানের ২৭ অনুচ্ছেদে সকল নাগরিক আইনের দৃষ্টিতে সমান ও আইনের সমান আশ্রয় লাভের অধিকারী এবং ২৮নং অনুচ্ছেদে ধর্ম, বর্ণ, লিঙ্গ, বাসস্থান বা পেশাগত কারণে কোনো নাগরিকের প্রতি বৈষম্য করা যাবে না বলে সুস্পষ্টভাবে উল্লেখ করা হয়েছে।

Homosexuality is criminalized in Bangladesh by Section 377 of the Bangladesh Penal Code, which states that consensual sexual acts between adults of the same sex are a punishable offence. This archaic law is not only discriminatory but also perpetuates negative stereotypes and attitudes towards the LGBTQ+ community in Bangladesh. It has resulted in the murder, rape, harassment, arrest, physical assault, and persecution of individuals based on their sexual orientation or gender identity.

বাংলাদেশে দন্ডবিধির ৩৭৭ ধারায় সমকামিতাকে অপরাধিকরণ করে প্রাপ্তবয়স্ক সমলিঙ্গের মানুষদের মাঝে স্বেচ্ছায় স্বজ্ঞানে সম্মতিসূচক যৌন ক্রিয়াকলাপকে শাস্তিযোগ্য অপরাধ হিসাবে গন্য করা হয়ছে। ব্রিটিশ উপনিবেশ যুগে প্রণীত আইনটি শুধুমাত্র বৈষম্যমূলকই নয়, বরং তা বাংলাদেশ বসবাসরত যৌন প্রবৃত্তিগত সংখ্যালঘু সম্প্রদায়ের প্রতি নেতিবাচক ও বাঁধাধরা মনোভাবকে চিরস্থায়ী করে। যার ফলে যৌন প্রবৃত্তি ও লিঙ্গ পরিচয়ের ভিত্তিতে নিয়মিত অসংখ্য মানুষকে হত্যা, শারীরিক ও মানসিক নির্যাতন, ধর্ষণ, যৌন হয়রানী, নিগ্রহ, বৈষম্য, মিথ্যা মামলায় জড়িত ও গ্রেফতারসহ বিভিন্নভাবে নিপীড়ন করা হচ্ছে।

The decriminalization of homosexuality by repealing Section 377 would have a significant impact on the LGBTQ+ community in Bangladesh. It would signal that discrimination and persecution based on sexual orientation or gender identity are not acceptable in a modern and progressive society. It would also provide legal protection to individuals who identify as LGBTQ+ and enable them to live their lives without fear of harassment or arrest.

দণ্ডবিধির ৩৭৭ ধারা বিলুপ্তিপূর্বক সমকামিতাকে নিরপরাধিকরণ করলে বাংলাদেশে যৌন প্রবৃত্তিগত সংখ্যালঘু সম্প্রদায়ের উপর গুরুত্বপূর্ণ ইতিবাচক প্রভাব পড়বে এবং যৌন প্রবৃত্তি ও লিঙ্গ পরিচয়ের ভিত্তিতে বৈষম্য ও নিপীড়ন একটি আধুনিক ও প্রগতিশীল সমাজে গ্রহণযোগ্য নয় বলে সমাজের নিকট বার্তা দিবে। যা আত্বস্বীকৃত যৌন প্রবৃত্তিগত সংখ্যালঘুদের আইনি সুরক্ষার পথ সুগম করবে এবং তারা বৈষম্য, সহিংসতা, নিপীড়ন, নিগ্রহ অথবা গ্রেফতারের ভীতি ব্যতিত স্বাভাবিকভাবে জীবন যাপন করতে সক্ষম হবে।

We believe that all individuals should be treated equally under the law, regardless of their sexual orientation or gender identity. Discrimination and persecution of individuals based on their sexual orientation or gender identity are a violation of human rights and do not align with the values ​​of a modern and progressive society.

আমরা বিশ্বাস করি যে সকল ব্যক্তিকে তাদের যৌন অভিমুখিতা বা লিঙ্গ পরিচয় নির্বিশেষে আইনের দৃষ্টিতে সমানভাবে বিবেচনা করা উচিত। যৌন প্রবৃত্তি ও লিঙ্গ পরিচয়ের ভিত্তিতে কারো প্রতি বৈষম্যমূলক আচরণ করা বা কাওকে নিপীড়ন করা মানবাধিকারের লঙ্ঘন এবং তা একটি আধুনিক ও প্রগতিশীল সমাজের মূল্যবোধের সাথে সামঞ্জস্যপূর্ণ নয়।

Therefore, we urgently call upon the Honorable President of Bangladesh to take immediate action to decriminalize homosexuality by repealing Section 377 of the Bangladesh Penal Code and ensure that all individuals in Bangladesh are protected from discrimination and persecution based on their sexual orientation or gender identity.

অতএব, আমরা যৌন প্রবৃত্তি ও লিঙ্গ পরিচয়ের ভিত্তিতে বাংলাদেশের সকল নাগরিককে বৈষম্য ও নিপীড়ন থেকে সুরক্ষা প্রদান নিশ্চিত করতে অনতিবিলম্বে বাংলাদেশ দণ্ডবিধির ৩৭৭ ধারা বাতিল করে সমকামিতাকে নিরপরাধিকরণের উদ্যোগ গ্রহণ করার জন্য গণপ্রজাতন্ত্রী বাংলাদেশের মাননীয় রাষ্ট্রপতির নিকট বিনীত প্রার্থনা করছি।
