The Issue

The West Virginia Attorney General is engaged in a lawsuit against the United States Government - Texas v. Becerra, attacking the civil rights of our disabled community, specifically, Section 504 of the Rehabilitation Act. A cornerstone of American civil rights law, Section 504 prohibits the discrimination against disabled persons by federally funded entities.

By participating in this lawsuit, the WV Attorney General threatens to declare Section 504 in its entirety unconstitutional and the protections afforded to our disabled citizens will be removed. It is estimated that 19.4% of West Virginians are disabled—far higher than the national average—meaning a significant portion of West Virginia's population will suffer from loss of their civil rights (source: Census, 2022 data).

The decision to pursue this lawsuit runs contrary to the interests of West Virginians. West Virginians stand firm in equality for all our citizens. We insist that West Virginia withdraw from the Texas v. Becerra lawsuit, and uphold Section 504 and its rules which protect the rights of our disabled community.

Sign this petition to send a clear message that West Virginians stand for equality, not discrimination.
