ALERT MERRITT ISLAND RESIDENTS: The Battle for Courtenay/Pioneer Apartments Isn't Over!

The developer we defeated in May is pursuing an administrative appeal to try and overturn the county's decision and force their high-density apartment complex onto our land. While they have the legal right to file an appeal process, they do not have the legal grounds to get what they are asking for. They are trying to claim our Agricultural (AU) land should be treated as commercial so they can use the Live Local Act.

We need to pack the room to let both the developer and the county know we are paying close attention and will not allow our zoning protections to be dismantled.

The Facts on Our Side:

 The Law is Explicit: The Live Local Act excludes AU agricultural land.

 The Claims are Legally Flawed: The developer is trying to use a 1983 permit for a hospital that was never built to claim the land is commercial. County staff confirmed in their June 23, 2026 report that this permit is completely abandoned, nonconforming, and legally invalid for this request.

 New 2026 State Law Protects Us: Florida's brand-new HB 1389 explicitly clarifies that agricultural activities and sales (like farmers' markets) do not make a zone commercial for Live Local eligibility.

The developer is counting on us not paying attention this time around. Let’s prove them wrong, pack the room, and show them that the law is firmly on our side. Please share this immediately!
