We are not “cancelling conservative voices”. We are concerned about Shannon’s constant efforts to cancel the voices and lives of whole groups of people and her attacks on people with differing opinions from her own. she doesn't believe in DEI, calling those that work to spread DEI efforts as "race hustlers".

HOW ON EARTH CAN SOMEONE SO FULLY ANTI-DEI BE ON A COMMISSION WHO'S MISSION STATEMENT IS ALL ABOUT DIVERSITY, EQUITY AND INCLUSION? 

(As a lawyer himself, Coyne should be well aware of this already!

In 1964, the landmark decision, New York Times v. Sullivan ( 376 U.S. 254), was issued by the United States Supreme Court. The decision held that the First Amendment freedom of speech protections limit the ability of public officials to sue for defamation. The “public official” limitation does not strictly apply to office holders – it applies to many persons in the public arena, including candidates.

In Sullivan, Justice Brennan, writing for the majority, stated that “debate on public issues should be uninhibited, robust and wide-open” and said that vehement criticism and even mistakes were part of the price a democratic society must pay for freedom.

As a result, the Sullivan decision adopted the “Actual Malice” test. For a “public official” to sustain a claim of defamation or libel against a person, the First Amendment requires that the plaintiff show that the defendant knew that a statement was false or was reckless in deciding to publish the information without investigating whether it was accurate.

Likewise, if a statement is merely an opinion, it cannot form the basis of a defamation claim. The First Amendment protects the right to voice opinions, criticize others and comment on matters of public interest. Although statements calling someone a “failure” or an “idiot,” may be hurtful, it is not illegal. These are “pure opinions” in a legal sense, because there is no way to prove them true or false.

Finally, the First and Fourteenth Amendments prohibit public figures and public officials from recovering damages for emotional distress in cases of satire or parody, absent a showing that there is a false statement of fact that was made with actual malice. Again, a parody may result in hurt feelings, but there is no basis to bring a defamation claim on such conduct if actual malice cannot be proven by the plaintiff.

☆☆☆☆Let it be known that we have counsel on this matter and we remain vigilant in our Petition to oppose Shannon Adcock and Kevin Coyne for board positions in Naperville. We would like to inform anyone threatening a defamation or harassment suit that we will avail ourselves to any counterclaims against them, and we would welcome discovery. We would also request opposing counsel review Rule 11 of the Federal Rules of Civil Procedure (relating to filings intended to harass), as well as the Illinois Rules of Professional Conduct, particularly Rule 3.1. We will pursue all sanctions and ethical complaints, where applicable.

We will not be threatened or intimidated by candidates for political appointment from exercising our First Amendment freedoms. This behavior is not becoming of anyone seeking a leadership position, nor is it conducive to maintaining a free society. We retain our right to voice our grievances against any public official of our choosing, as well as engage in political discourse on any topic permissible under the First Amendment of the United States Constitution.☆☆☆☆
