OPEN LETTER TO UNITED STATES EPA,

August 5, 2018

RE: Compliant, Appeal and Request for The National Freedom of Information Act

Dear Environment Protection Agency (EPA),

I'm writing this letter to notify the EPA agency that it has NOT conducted the environmental /quality review on Arroyo Grande Oil Field in San Luis Obispo County and I would like to know when are you going to do it? In addition to a compliant, appeal letter and request for Freedom of Information Act on the issues, I have listed below and I would like written answers to each one in the U.S. mail.

The current water wells and tap water crisis demonstrates that the public health is not protected when the EPA gets multiple warning letters and emails from myself and others about water contamination in the local water wells in the immediate area of the Arroyo Grande Oil Field in Arroyo Grande, CA. The fracking chemicals used at the Arroyo Grande Oil Field have not been reported to the local, state and federal authority's for many years. I discovered the fracking chemicals when I reviewed the water board records. That is were I learned that the water wells near the Arroyo Grande oil field are contaminated. The public does not know to what degree the contaminates are because the EPA has not been to the Arroyo Grande Oil Field/Phillips 66 Refinery site and investigated each well near the oil field and ponds/creeks near the oil field/refinery and Pismo Creek near my home. Also the name of these residents effected have a gag order placed on the public on reveling their names and addresses. In addition, the wastewater treatment center makes my water smell like a bottle of bleach every-time I turn on my faucet.

The EPA should have authority to issues an emergency order to protect the Arroyo Grande community and San Luis Obispo County residents. The emergency order should included investigation, discovery, long term monitoring and compliance with the Arroyo Grande Oil Field, Phillips 66 Refinery, Water Treatment Centers, Water Wells, Tap Water, Water Beds and the various Water Boards in these communities. The EPA should inform the public citizens/private business and community of San Luis Obispo County the names of the contaminates and maintain a list on The EPA website of these contaminates, for public disclosure purposes.

1. The EPA should issue an administrative order for San Luis Obispo County and I would like to know when you are going act on these requests?

2. Commence civil actions orders immediately for responsibility parties on the Arroyo Grande Oil Field on the spills, cracks and leaks of contaminates in the locals citizens water wells and tap water in the immediate area of the Arroyo Grande Oil Field, Phillips 66 Refinery and San Luis Obispo County as a whole.

3. We request the you do not withhold grant funds to the public or private businesses for clean up purposes.

4. We demand that you conduct emergency authority to address the current water problems from the contaminates of the spills, cracks and leaks at the Arroyo Grande Oil Field and Phillips 66 Refinery. Also when their is a compliant made to the EPA offices report it on your website for the public to see immediately.

5. Do you follow the Local, State and Federal Standards for the California Safe Drinking Water Act Program? And abide by the Civil Rights Act to not violate or discriminate in any shape or form with the public at large?

6. We demand that you strengthen the over-site State drinking water programs and act quickly in times of emergency when their is a compliant made.

7. When will you follow through with the Environmental/Quality Review on the Arroyo Grande Oil Field and Phillips 66 Refinery?

8. I hope you agree that Oil Fields and Refinery should not be exempt from the California Safe Drinking Water Act Program and if they are, WHY is that?

9. There has NEVER been a Environmental/ Quality Review at the Arroyo Grande Oil Field. This has set a precedent for constitutional violations for the community in many State, Federal Statutes and Rules. Do you agree or not? Give me a detail reason for your answer?

10. We demand that you INVESTIGATE the water wells/ tap water near the Arroyo Grande Oil Field and Phillips 66 Refinery immediately for contamination. In addition, inform the public about their health and property risk.

As you are aware that ignoring the red flags about oil spills, cracks and leaks and the water quality in the many years that the Arroyo Grande Oil Field and Phillips 66 Refinery has existed is criminal in nature.

Please, mail me the results of all oil spills, cracks and leaks of both places and the peoples name, address and dates that these allegations were reported. Also include the last Environmental/Quality Review outcome data and table of contents of both places! Mail me these results very soon, do not refer me to another agency to look this information up myself. I want to know, what you are aware of and not aware of!

The community ask that you create a better risk- assessment system for the drinking water programs such as water wells, tap water and wastewater treatment centers throughout San Luis Obispo County near the Arroyo Grande Oil Field and Phillips 66 Refinery.

I suggest that you create a system that tracks complaints and gathers information on the many emerging issues and post the questions and answers on the EPA website.

The system should assess the risk associated with the complaints, including efficient and effective resolution. Including providing the public with all the results from the EPA review, conclusion and table of content of the Arroyo Grande Oil Field and Phillips 66 Refinery outcome. Including the California Safe Drinking Water Act Program and how you track the progress of identified correction actions.

Do you provide mandatory regular training for the EPA drinking water staff, managers and senior leaders for the California Safe Drinking Water Act Program? How often and what guidelines do you use in the training program?

We would like to see you improve oversight by establishing a clear and credible policy for the EPA staff that involves the intervention in the State. The policy should provide steps for the EPA to follow. And inform the State what will happen if the State does not act according to these safety guidelines. People lives and Property are in dangers and waiting 1 year or more is unethical and criminal.

We expect that you publicly document the clear expectation roles and responsibilities between the EPA and the State of California in an official document such as a memorandum and table of content of the understanding of the pros and cons of each decisions made about the quality of well water, tap water and wastewater treatment centers. Specifically, in regards to spills, cracks, leaks and the maintenance at the Arroyo Grande Oil Field and Phillips 66 Refinery in San Luis Obispo County.

To secure that the citizens Constitution, Civil and Human Rights are protected. In addition, including "The Freedom of Information Act" notice and for the public to act to obtain information, if they chose to make a compliant or investigate their water quality.

Attention to disclosure information must address the investigation, evaluation, issues related to the public health, the environment and post it on your website for public review with the table of content included.

In closing, I ask that you urgently conduct the environmental/quality review on the Arroyo Grande Oil Field and Phillips 66 Refinery in Nipomo immediately. When finished with the review and report, post all information involved in this process on your website for State and Federal Public Disclosure Laws/Open -Records Laws/E-FOIA / FOIA/Sunshine Laws for review and mail me a copy, including the table of content.

Note: Include a list of medical conditions that people have developed from drinking the water in San Luis Obispo County. I can tell you that Cancer is very high, Infant Morality and Fetus Rare Disorders and ASL are a massive problems in San Luis Obispo County. Is our water killing us, prove me wrong?
