TODAY AN ATHLETE. TOMORROW A FUTURE, NOT AN EMERGENCY.

🇮🇹 OGGI ATLETA.

🇬🇧 TODAY AN ATHLETE. TOMORROW A FUTURE, NOT AN EMERGENCY.

From protection in times of crisis to prevention after a sporting career

Can we ensure that, when a sporting career ends, the equine athlete is not at risk of becoming an emergency case, but can instead rely on preventive measures for protection and support?

The equine athlete is part of a sporting, economic, educational and social system. It contributes to the practice and development of equestrian sport in a context involving people of all ages and circumstances, from children to older people and people with disabilities.

Its welfare should be considered not only during sporting performance, but throughout its entire life, in line with Article 13 of the Treaty on the Functioning of the European Union, which recognises animals as sentient beings and requires their welfare requirements to be fully taken into account in relevant policies.

THE CURRENT SYSTEM: PROTECTION IN EMERGENCY SITUATIONS

When an equine is abandoned, mistreated or in need of custodial care, the legal system provides for intervention measures and forms of placement and protection. There are also provisions governing specific forms of support for animal protection activities, subject to the conditions and procedures established by current legislation.

In particular, Article 8 of Italian Law No. 189 of 20 July 2004 contains provisions concerning the allocation of revenues from the financial penalties established by that law. As regards custody costs, Article 58 of Presidential Decree No. 115 of 30 May 2002 governs, within the procedures provided for by law, aspects relating to the custody and preservation of assets subject to seizure, under the conditions established by the applicable legislation. A further instrument is provided for by Italian Law No. 199 of 30 December 2025. Article 1, paragraph 847, provides for an allocation of one million euros for each of the years 2026 and 2027 to cover specific custody costs arising from the seizure and confiscation of animals used in fighting and animals with behavioural problems entrusted to specialised behavioural rehabilitation facilities managed or supported by Third Sector organisations. Director’s Decree No. 116 of 19 June 2026 governs the procedures for accessing, using and disbursing these resources. The measure applies to the categories of animals and the conditions specified by law; it does not establish a general fund for all seized or confiscated equines.

These instruments address specific needs and represent an important component of the protection system. However, the prevention of difficulties that may arise after the end of a sporting career remains a distinct issue.

FROM PROTECTION AFTER A CRISIS TO PREVENTION AFTER A CAREER

When the public system intervenes to protect animals in certain emergency situations, using resources that may also come from general taxation, it is legitimate to consider whether preventive safeguards could also be established for the period following a sporting career.

In these situations, the care and protection of equines may also place a burden on the associations and organisations that take them in. Their work is supported not only by any available public contributions, but also by the generosity of donors.

This is a valuable contribution that reflects the compassion of those who choose to support animals, but it also raises a fundamental question.

Should the protection of an equine athlete, after a life dedicated to sport, depend predominantly on public intervention and the generosity of donors, rather than on a system of shared responsibility that recognises the value of its contribution to equestrian sport? The aim is not to challenge emergency protection measures or the work of the associations and organisations that take in and protect animals, but to integrate these interventions with a preventive strategy.

If the equine athlete is an integral part of equestrian sport, why should the sporting system that uses and benefits from its performance not contribute to ensuring adequate measures so that its welfare can continue to be protected after its career ends?

WHAT EQUICAMMINO PROPOSES

Two measures to ensure continuity in the knowledge and protection of the equine athlete beyond its sporting career.

1. An integrated European system for understanding and protecting the equineAn integrated European system linking existing identification data with the equine’s sporting history and information relevant to the post-career period, in order to understand its journey and support appropriate solutions for its future and welfare.

Not only knowing who owns the equine, but knowing who that equine is.

The proposal aims to build on and integrate existing systems, without assuming that identification and registration tools are currently lacking. The objective is to ensure greater continuity of information, including when equines are transferred between countries, and to make it easier to reconstruct their sporting history and information relevant to the post-career period.

2. A Post-Career Fund A Post-Career Fund financed through a contribution from the sporting system that has benefited from the use of the equine, without recourse to general taxation.

The Fund is intended to support the equine’s welfare after its sporting career ends, without replacing the responsibilities of the person in charge of its care or relieving them of those responsibilities.

The responsibility of the person in charge of the equine remains fundamental, but the protection of the equine athlete must also be ensured through preventive measures, so that, if the owner is unable to guarantee its welfare, protecting the equine athlete does not become an exclusive burden on the public system, which may be called upon to intervene in the absence of an adequate contribution from the sporting system that benefited from its use.

The Fund should translate this principle into a practical instrument, with transparent funding arrangements, eligibility criteria and defined purposes, together with safeguards to prevent it from being used to evade or transfer individual responsibilities.

THE PRINCIPLE THAT GUIDES US

Ethics does not end with the principles that guide sport during competition. It is also measured by the responsibility shown towards those who made those achievements possible. A sporting career has a beginning and an end.

THE EQUINE’S LIFE CONTINUES.
