On June 15, 2023, the Minnesota Department of Human Rights published a determination that high-luminance, strobing LED lights are discriminatory. (https://www.softlights.org/wp-content/uploads/2023/06/74059-6-15-2023-ECP-Memorandum-.pdf)
This our biggest victory so far. While this ruling is specifically for a device called an RRFB that uses LED strobe lights at pedestrian crossings, the discrimination occurs because of the intense, unregulated LED light. The seizures and migraines that the RRFBs cause are also caused by LED vehicle headlights. Therefore, the MDHR finding is easily expanded to include LED vehicle headlights.
The Soft Lights Foundation has already notified NHTSA, FHWA, Department of Justice, Access Board, and other agencies about this precedent-setting legal ruling and we have asked for action by these federal agencies to protect us from LED visible radiation and LED headlights.
