Recall of Allan Bernstein Announced

Protect Our Kids At Tustin Legacy
3 dic 2018

Today we’re pleased to announce the formal recall of Allan Bernstein from Tustin City Council.

We intend to recall and remove Allan Bernstein from the Tustin City Council. The primary basis for Council Member Bernstein’s recall is his reckless disregard for the safety and welfare of Tustin’s children as demonstrated by his November 6, 2018 vote to place a homeless shelter five hundred (500) feet away from Heritage Elementary School and across from a future toddler splash pad and playground. In making this decision, Council Member Bernstein failed to consult with the school’s administration, the Tustin Unified School District, the Tustin School Board, the Parent Teacher Association, the Tustin Planning Commission and the community.

During the November 5, 2018 town hall meeting, the Tustin Chief of Police confirmed that this location will add risk to the security of the school’s students and that the Tustin Police Department cannot guarantee the safety of the children, some of which are as young as four. While we implored Mr. Bernstein to support children and their safety, he voted to put them at risk.

Additionally, several Tustin residents have reached out with allegations of ethical violations involving the solicitation of donations as well as Council Member Bernstein's engagement in conflicts of interest and other inappropriate behavior.

We’ve received a tremendous outpouring of support leading up to this recall initiative. We know that a large group of residents are looking to sign as quickly as possible. We wanted to outline the next steps and timelines associated with the recall:

  • Step 1 – Notice of Intention – Completed
  • Step 2 – Serve and File – Allan Bernstein will receive a copy of the Notice at his home as well as at Tustin City Hall as well as being served in person.
  • Step 3 – Publish the Notice – We will have the Notice published in the OC Register this week pursuant to the official recall guidelines.
  • Step 4 – Recall Petition – Once we have everything signed off, we will be able to circulate the recall petition. This should occur within the next two weeks.
  • Step 5 – Recall Election – Once we collect the necessary signatures, we will have a special election in the City of Tustin to vote on the recall and then choose an individual to take over for Allan Bernstein.

We have launched a website, advertising campaign, press release, email campaign, and media campaign amongst other efforts. We’ve ordered hundreds of yard signs for distribution and will have a city-wide organizational undertaking to collect signatures.

We will bring common sense and order back to Tustin City Council by installing a City Council that values children and their safety. You can find more information, sign up to know when the recall petition is ready, volunteer and donate at: https://www.tustinrecall.com
