Why This Case Is Bigger Than Just Kilmar

Explanation of what's really happening — not just to Kilmar, but to the entire legal system that’s supposed to protect people like him.

In 2019, a U.S. immigration judge ruled that Kilmar could not be deported to El Salvador because his life would be in danger from local gangs. That decision was legally binding. It protected him under a law called the Convention Against Torture, which the U.S. adopted through the United Nations and made official through federal law in 1998.

Kilmar was also living legally in Maryland under Temporary Protected Status (TPS) — meaning the U.S. had already recognized that El Salvador was too dangerous for people like him to return to.

But earlier this year, the Trump administration illegally deported Kilmar anyway — ignoring that protection. Their own lawyers admitted in court that it was an “administrative error.” But now, people like Trump adviser Stephen Miller are publicly claiming it wasn’t a mistake at all — they’re defending the deportation.

Now Kilmar is being held in one of the most dangerous prisons in the world, CECOT in El Salvador, with no charges, no trial, and no way out.

The U.S. Supreme Court already ruled that the government must “facilitate” Kilmar’s return. But instead of doing that, the Trump administration is saying they’ve done enough — even though Kilmar is still locked up abroad.

Even worse, El Salvador’s president refuses to let him go and is calling him a “terrorist” with no proof.

So here’s the truth:

A Maryland resident with court-ordered protection was secretly deported.
He’s now trapped in a foreign prison.
Both governments are blaming each other — and no one is getting him out.
Meanwhile, members of Congress and even Kilmar’s union are speaking out. But unless we all raise our voices, this will keep happening — not just to Kilmar, but to others.

This case is no longer just about one man. It’s about whether any of us are protected when the government decides to ignore the law.
