🌍LA VICTOIRE DES « OUTREMERS » 

Le 1er mai 2026, la Charte sociale européenne est enfin entrée en vigueur dans la majorité des territoires français dits d’« Outremer ». Près de 3 millions de personnes bénéficient désormais pleinement des droits humains économiques, sociaux et environnementaux garantis par la Charte.

Elle reste inapplicable à ce stade seulement à la Nouvelle-Calédonie, à la Polynésie française et à Wallis-et-Futuna – dont les assemblées locales doivent être préalablement consultées, conformément à leur statut constitutionnel et à leur inscription sur la liste de l’ONU des territoires non autonomes à décoloniser.

Cette victoire est le fruit d’une mobilisation collective portée par la campagne « Tous Humains ».

Quelques étapes clés

• Décembre 2025 : deux auditions de Kimbé Rèd FWI à l’Assemblée parlementaire du Conseil de l’Europe, une Conférence organisée par les parlementaires à l’Assemblée nationale, une tribune dans Le Monde et un recours en justice de Kimbé Rèd FWI avec Notre Affaire à Tous placent la question de l’égalité des droits au cœur du débat public.
• Janvier 2026 : l’Assemblée parlementaire du Conseil de l’Europe adopte une Recommandation dénonçant les clauses excluant certains territoires des traités de droits humains.
• Mars 2026 : le Conseil de l’Europe réaffirme la nécessité d’étendre la Charte à l’ensemble des territoires concernés.
• 18 mars 2026 : Kimbé Rèd FWI, avec l’appui de ses partenaires – Volonteurope, la FIDH et la Conférence des OING du Conseil de l’Europe - organise un événement parallèle à la Conférence ministérielle du Conseil de l’Europe sur la Charte sociale européenne à Chișinău, Moldavie.
• 19 mars 2026 : à Chișinău, la France annonce officiellement l’extension de la Charte sociale européenne aux territoires dits « ultramarins ».
• 1er mai 2026 : cette décision entre en vigueur.

🌍THE VICTORY OF THE “OVERSEAS” POPULATIONS 

On 1 May 2026, the European Social Charter finally entered into force in the majority of the French so-called “Overseas” territories. Nearly 3 million people now fully benefit from the economic, social, and environmental human rights guaranteed by the Charter.

At this stage, the Charter still does not apply to New Caledonia, French Polynesia, and Wallis-and-Futuna, whose local assemblies must first be consulted, in accordance with their constitutional status and their inclusion on the United Nations list of Non-Self-Governing Territories to be decolonized.

This victory is the result of a collective mobilization led by the “All Human” campaign.

Key milestones

• December 2025: two hearings of Kimbé Rèd FWI before the Parliamentary Assembly of the Council of Europe, a Conference organized by members of parliament at the French National Assembly, an op-ed published in Le Monde, and legal action brought by Kimbé Rèd FWI together with Notre Affaire à Tous placed the issue of equal rights at the heart of public debate.
• January 2026: the Parliamentary Assembly of the Council of Europe adopted a Recommendation condemning clauses excluding certain territories from human rights treaties.
• March 2026: the Council of Europe reaffirmed the need to extend the Charter to all concerned territories.
• 18 March 2026: Kimbé Rèd FWI, with the support of its partners – Volonteurope, FIDH, and the Conference of INGOs of the Council of Europe – organized a side event during the Council of Europe Ministerial Conference on the European Social Charter in Chișinău, Moldova.
• 19 March 2026: in Chișinău, France officially announced the extension of the European Social Charter to the so-called “Overseas” territories.
• 1 May 2026: the decision entered into force.
