A few days back I was talking to a female friend and she said its really too discomforting when on menstruation.

Talking to her frankly about the problems i couldn't really figure out that if as a constant we take 50% of the total world population to be females, how strong women are that they never compromise their work because of this. And i realised that no house in this world is spared of having women in family, and still, we do not realise how hard it is for them.

Taking inspiration from her, and all the women in the world, I went to check the constitutionality, if, there is any provision in our Constitution to provide justice to them, and what the provisions are there. They are not only the constitutional provision, but are the provisions inspired from and working to establish the natural justice.

It's not like that, that I am the only person who has raised this topic for discussion, earlier too it was mooted but couldn't overwhelm our narrow mindedness. And also it contained the demand for providing an off to women when they are on periods. But in my opinion there shouldn't be an off, but there should be the right (or at least the discretion) available to women to decide that in the days of menstruation "should they work from home, or at office". To keep their comfort equal to men, because men do not have menstruation thus don't need to suffer menstruation problems too.

Thus, what I could conclude is:

• by article 19 they have the right to speak their and problem and also the right to be listened to, wherever they work

• by the article 14, 15, and 16 this non availability of this choice in itself is a discrimination

• and thus their right to live and work in a comfortable and humane conditions stands violated (definition's given in Article 21 of the Indian Constitution).

It is too painful to realise that i the advanced age i.e. in the year 2020 still women in India can't exercise their freedom of speech, expressions freely. They still need to hide their issues, and menstruation is not a problem or and issue  but is a biological process necessary for fertility and the growth of human race.
