Justice for Miguel
The Issue
Miguel was five years old and died on June 2nd after falling from the 9th floor of a high luxury building in the neighborhood of Santo Antonio in Recife. According to the PMPE, the case occurred at 1 pm, at the condominium Píer Maurício de Nassau, known as "Twin Towers".
Miguel Otávio Santana da Silva was the only son of Mirtes Renata Santana de Souza. She worked as a maid on the fifth floor of the building where her son fell.
On that day, at the height of the social isolation caused by the sanitary pandemic (COVID-19), Mirtes was ordered to go to her employer's house and, given the closing of schools and day care centers, she had to take Miguel with her. While the mother was carrying the dog, Miguel was left in the care of Sari Gaspar Corte Real, Mirtes' mistress. The child started crying for his mother and was left by Sari - with extreme insensitivity and negligence - alone in one of the service elevators. Miguel ended up getting lost and got out of the elevator on the 9th floor. Looking for his mother, the little boy scaled a railing, fell from a height of approximately 35 meters. He was taken to the hospital with his life and several fractures and bleedings, but he did not resist.
We want justice for the life of little Miguel and for his entire family, the victims of a deliberate action of abandonment, motivated by feelings of meanness, prejudice, and impatience. The Civil Police investigation, closed within the legal timeframe, concluded that Sari Corte Real was indicted for the crime of abandonment of an incapacitated person resulting in death.
The Public Prosecutor's Office of Pernambuco promptly charged Sari Corte for the crime of abandonment, and the indictment was received. After some unjustifiable months of slowness to carry out simple acts such as the summoning of the defendant and her lawyers, an evidentiary hearing was scheduled for December 3, 2020.
That the appropriate criminal, civil and labor measures be taken for Miguel's family.
The success of the evidentiary hearing also depends on the timely summoning of all the witnesses indicated by the defense and the prosecution. There are almost 20 people who need to be formally notified of the procedural act, under penalty of postponement. It is fundamental to maintain vigilance in relation to the work of procedural management, so that there are no embarrassments or nullities that hinder the conclusion of the instructional phase.
Miguel's life matters and is worth much more than the R$20,000 ($ 4.207,25) that Sari Gaspar posted as bail to answer the lawsuit in freedom. We demand justice and that the person responsible pays for the crime.
