Petition to End Unconstitutional Covid-19 Mandates in Canada

The Issue

We, The People of Canada, have been granted certain right and freedoms, guaranteed to us under Canada's Charter of Rights and Freedoms of 1982, specifically:

Section 1 - Guarantee of Rights and Freedoms

  • fundamental freedoms, democratic rights
  • the right to live and seek employment anywhere in Canada
  • legal rights (life, liberty and personal security

Section 2 - Fundamental Freedoms

  • freedom of conscience and religion;
  • freedom of thought, belief, opinion and expression;
  • freedom of peaceful assembly; and
  • freedom of association

Section 7 - Life, Liberty and Security of Person

7. Everyone has the right to life, liberty and security of the person and the right not to be deprived thereof, except in accordance with the principles of fundamental justice.

Section 9 - Detention or Imprisonment

9. Everyone has the right not to be arbitrarily detained or imprisoned.

Section 12 - Treatment or Punishment

12. Everyone has the right not to be subjected to any cruel and unusual treatment or punishment.

And, Section 52 of the Constitution Act of 1982

52. (1) The Constitution of Canada is the supreme law of Canada, and any law inconsistent with the provisions of the Constitution is, to the extent of the inconsistency, of no force or effect.

Though Health Canada Guidelines are vague, the United States Centers for Disease Control and Prevention (CDC) have clearly stated that wearing masks and physical distancing are as effective at protecting the individual from Covid-19 as vaccines are, we must conclude that those practicing these safety measures are at very low danger of contracting Covid-19 from those who choose not to wear masks or take the vaccines.

Therefore, we must conclude that Canadians who are safe from contracting Covid-19 have no cause or justification to force any other individual to wear a mask or be vaccinated against their will. The People's right to sovereignty over their own bodies must be held sacrosanct. Furthermore, we must conclude that, as it is the individual's responsibility to protect themselves from Covid-19, no business owner should have to alter their business practices to comply with arbitrary Covid-19 restrictions. These restrictions do little to enhance protection for patrons. They only cause unnecessary hardship for the business owner.

In conclusion, We, The People of Canada, hold that all Covid-related mandates, whether applied and enforced by any group or level of government, are in direct violation of our rights and freedoms as Canadian citizens, as laid out above, and, as such, are not legally enforceable.

As such is the case, we humbly, yet firmly, petition our federal government to immediately strike down and render unenforceable any rules mandates or laws that violate our rights and deprive us of our liberty as citizens of this great country of ours. Furthermore, we petition our federal government to protect us from harsh and unjust discrimination from any group or individual in relation to arbitrary and authoritarian Covid-19 rules and mandates.
