The court ruling has just been handed down in the legal case brought by Winston Godwin and Greg DeRoche, following their marriage application being declined by Bermuda’s Registrar-General, with the court making an historic ruling in their favour, saying “the common law discriminates against same-sex couples by excluding them from marriage.” The couple was represented by Mark Pettingill, and today Justice Charles-Etta Simmons ruled in favour of the couple. The Court’s conclusion stated, “The common law definition of marriage, that marriage is the voluntary union for life of one man and one woman, and its reflection in the Marriage Act section 24 and the MCA section 15 (c) are inconsistent with the provisions of section 2 (2) (a) (ii) as read with section 5 of the HRA as they constitute deliberate different treatment on the basis of sexual orientation. “In so doing the common law discriminates against same-sex couples by excluding them from marriage and more broadly speaking the institution of marriage.” http://bernews.com/2017/05/court-rules-in-favour-of-gay-couple/
