Now is the Time to Impeach Texas Governor Greg Abbott

The Issue

I am the victim of Greg Abbott's lawlessnes.  Having over $5900 stolen from me when he was attorney general when he sent a withholding order to Social Security garnishing $290 a month from my disability beginning May 2005 and continuing until October 2008 which accumulated $11,600 in state seizure of my federal benifits when the court order was for $190 a month and the total I owed was only $5,100.  Social Security notified the Attorney General that I had provided court records proving the overpayment and directed the state to send an order ceasing the garnishment which Texas did do.  The followiing month the Office of the Attorney general files a noitice of lien in the District Court which was fraudulant claiming an outstanding balance owed to Texas for $5200 and the document filed in the court stated no payments had ever been made.  The Lien was entered into the official court record and became a civil judgement without a judges order.  The lien appeared on my credit reports as a public record and affected my ability to get loans and raised my insurance rates.

I filed a lawsuit to recover the over collected money from the Attorney General after being told the money was just gone and that I couldn't expect for them to take the money from someone else to repay me.  That just wouldn't be right.  But I guess it was right to take my money and give it to someone else.    

When the court hearing was held an assistant attorney general appeared for the Attorney General and filed a motion in the court to have my suit dismissed claiming Greg Abbott had soverign immunity and could not be sued.  A visiting judge was sent to the court from Austin to hear the case and granted the motion to dismiss.   That was December of 2015.

To this day I have never received the money that was stolen from me.

Greg Abbott has acted as a monarch would act.  Taking from the citizens whenever he felt like it then when he is cought asserts immunity as a soverign.

By his own actions he has taken what was intinded to protect the state from frivioulus lawsuits and the taxpayers taxes from being taken by those seeking to drain the treasury and used it to commit theft and fraud and when it is discovered uses the law meant to protect the state from fraud to protect himself.

To me he is no different than a common criminal.  

We can add the actions he has committed during Covid-19 which has caused financial hardship and mental anguish to many.  Beginning with his declairing the state is reopened 100% as of March 31, 2021 as if the health crisis has ended and the pandemic has been beaten yet there are more cases every day being reported and the CDC has made masks for everyone a recommendation including those who have been vaccinated and here is our Governor trying to keep his no mask mandate in force trying to get the Supreme court to approve it.

Since when did the Governor know more than the CDC does regarding the safety and health of the Texas population? he is not following their recomendations and guidlines which is placing people at risk.

 

Then there is the termination of the Federal unemployment benefits which were passed into law by the us congress in order to assist persons affected by the pandemic with money to pay for the necessary living expenses which they cant pay for without it.  The money is paid from the Stafford Act when a disaster is declared by the US President.  What gives one person the right to unilaterally stop all beneficiaries from receiving the federal disaster funds that were approved by the US congress when the money paid to the people is not money paid by the state or the employers.  How many unemployed people are struggling financially after June 27 because the governor decided they don't need the assistance any more yet the health crisis continues and is growing every day.

Last let me inform you that on October 29, 2017 Governor Abbott appointed Joey Contreras the federal prosecutor in San Antonio to fill the 187th District Court Judge position.  Article 5 of the Texas Constitution states all judges are to be elected by the people.  When a judge retires or becomes disabled and no longer can perform his oath of office the Governor is allowed to fill the position with an appointee.  However to fulfill the constitutional requirement the appointee must be confirmed by 2/3 majority vote of the Texas Senate after being nominated in the senate by a senator and having been vetted by the nominations committee.  If the Senate is not in session then the appointee may fill the position and the governor must have the appointee submitted within the first 10 days of the next session of the Senate.  When Joey Contreras was appointed the Senate had just ended a special session  and was recessed until the next session that began Janyuary 2019.  The rule enacted for the appointment when the senate is not in session stipulates if an appointee begins his appointment before November 2 and there is a general election the following year that will give the voters the ability vote for the individuak they want in the office then the person is not required to be nominated in the next session of the senate for confirmation as the people will decide if the person is qualified to remain in the position.   Joey Contreras was appointed and took the bench in October before the November 2 date which meant that either the Governor called another special session for the appointment or the Governor saw that he was nominated in the next session of the Senate.   Joey Contreras lost the election and was replaced as the 187th District court Judge.  In January when the next session of the Senate was held Governor Abbott did not have him nominated in the senate and he was never voted on by the senators to be the appointee.  The constitutional requirement was not kept aven though Contreras was no longer the Judge he still was required by the operation of the constitution to be vetted and voted on.  The requirement to be voted on by the senate was not fulfilled resulting in the appointee not having constitutional authority or lawful jurisdiction in the court to convict people and issue lawful orders.  as of today there are many people in prison, on probation and have paid millions of dollars to the state on the orders of a person who did not follow the constitutional requirements and all of his orders became null and void.

And if his are not Null and Void then we are willing to allow one sole individual to appoint whome ever they want to to fill a position which is reserved for the people to determine that abridges the Texas Constitution.  If this is the case then why have a constitution in the first place if were not going to hold our government offiacials acountable to comply with it.

 

So I make a motion to the Texas Senate for violation of artice 2 of the Texas Constitution by Governor Abbott and for the crininal act of Theft and Fraud by deception, racketeering, depervation of rights under color of law and conspiracy to commit by judicial fraud is n the District courts.when he was Attorney General.  The citizens of Texas demand the speaker of the house to begin impeachment proceedings to remove Greg Abbott from the Governorship of the State Of Texas
