The Youth Statement:

We, youth from among the countries that retain gender-discriminatory nationality laws and allies, seek to realize a world where all women have the right to pass on their citizenship on an EQUAL basis with men. We stand united in calling for an end to gender discrimination in nationality laws, a framework that considers women as second-class citizens and inhibits sustainable development. These discriminatory laws harm entire families, destabilize communities, and deny countless persons the opportunity to thrive.

Today, over twenty countries have nationality laws that deny women the right to confer their nationality to their children on an equal basis with men. Over forty countries deny women the equal right to pass their nationality to a non-citizen spouse. Those denied citizenship as a result of gender discrimination in nationality laws often face obstacles in accessing education, healthcare, employment, financial services, property rights, inheritance, and freedom of movement. They may even be rendered stateless. These discriminatory nationality laws are contributing to poverty and holding countries back.

A world without gender discriminatory nationality laws would be transformative. It would mean more children growing up fulfilling their potential, more families living in dignity and stability, and stronger societies benefiting from the contributions of all their citizens’ children. More children could dream freely, learn without barriers, and thrive without bureaucratic obstacles. Such a world would foster prosperity, unity, and opportunity that benefits everyone.

We call on all governments, policy makers, and politicians to act NOW. Reform nationality laws to uphold equality. It is not only the right thing to do, but it is the smart thing to do. Putting this discrimination behind us once and for all is in the interest of everyone.

We call on civil society, the United Nations, and those committed to advancing gender equality, children’s wellbeing, and sustainable development to amplify our voices, raise their efforts, and advocate with us to end gender discrimination in nationality laws.

By upholding gender equality in nationality laws, we can create a more equitable, just, and prosperous future. Let us work hand in hand to build a world where no one is denied their inherent right to belong and no woman is denied equal citizenship.

In October 2024, Malaysia’s lower house (Dewan Rakyat) passed a landmark bill eliminating discrimination against women in nationality laws. This new legislation grants Malaysian women the right to pass their nationality to their children on an equal basis with men. The bill was subsequently passed by the Senate (Dewan Negara) in December 2024 and is now awaiting official gazettement by the council of rulers to take effect.

البيان الشبابي:

نحن الشباب والشابات من بين الدول التي مازالت لديها قوانين جنسية تمييزية بين الجنسين وحلفاؤنا، نسعى إلى تحقيق عالم تتمتع فيه جميع النساء بالحق في منح جنسيتهن على قدم المساواة مع الرجال. إننا نقف متحدين في الدعوة إلى وضع حد للتمييز بين الجنسين في قوانين الجنسية، وهو إطار يعتبر المرأة مواطنة من الدرجة الثانية ويحول دون تحقيق التنمية المستدامة. تضر هذه القوانين التمييزية عائلات بأكملها، وتزعزع استقرار المجتمعات، وتحرم عددًا لا يحصى من الأشخاص من فرص الازدهار.

اليوم، هناك أكثر من عشرين دولة لديها قوانين جنسية تحرم المرأة من حقها في منح جنسيتها لأولادها على قدم المساواة مع الرجل. وهناك أكثر من أربعين دولة تحرم المرأة من حقها في منح جنسيتها لزوجها غير المواطن. غالبًا ما يواجه المحرومين والمحرومات من الجنسية نتيجة للتمييز بين الجنسين في قوانين الجنسية عقبات في الحصول على التعليم والرعاية الصحية والعمل والخدمات المالية وحقوق الملكية والميراث وحرية التنقل. وقد يصبحون حتى عديمي الجنسية. وتساهم قوانين الجنسية التمييزية هذه في الفقر وتعيق البلدان.

عالم خالٍ من قوانين الجنسية التمييزية بين الجنسين من شأنه أن يحدث تغييرًا جذريًا. فهو يعني أن المزيد من الأطفال سيكبرون ويحققون إمكاناتهم، والمزيد من الأسر التي تعيش بكرامة واستقرار، ومجتمعات أقوى تستفيد من مساهمات جميع أولاد مواطنيها ومواطناتها. يمكن لعدد أكبر من الأطفال أن يحلموا بحرية، ويتعلموا دون حواجز، ويزدهروا دون عوائق بيروقراطية. مثل هذا العالم من شأنه أن يعزز الازدهار والوحدة والفرص التي تعود بالنفع على الجميع.

ندعو جميع الحكومات وصانعي السياسات والسياسيين للتحرك الآن. أصلحوا قوانين الجنسية لدعم المساواة. إنه ليس فقط الشيء الصحيح الذي يجب القيام به، ولكنه الشيء الذكي الذي يجب القيام به. إن وضع هذا التمييز وراءنا، مرة واحدة وإلى الأبد، يصب في مصلحة الجميع.

إننا ندعو المجتمع المدني والأمم المتحدة والملتزمين بتحقيق المساواة بين الجنسين ورفاه الأطفال والتنمية المستدامة إلى رفع أصواتنا وإعلاء جهودنا والدعوة معنا لإنهاء التمييز بين الجنسين في قوانين الجنسية.

من خلال تكريس المساواة بين الجنسين في قوانين الجنسية، يمكننا خلق مستقبل أكثر إنصافاً وعدلاً وازدهاراً. فلنعمل يداً بيد لبناء عالم لا يُحرم فيه أحد من حقه الأصيل في الانتماء ولا تُحرم فيه أي امرأة من المساواة في الجنسية.

* في أكتوبر 2024، أقر مجلس النواب الماليزي مشروع قانون تاريخي يلغي التمييز ضد المرأة في قوانين الجنسية. يمنح هذا التشريع الجديد المرأة الماليزية الحق في منح جنسيتها لأبنائها على قدم المساواة مع الرجل. وقد أقر مجلس الشيوخ مشروع القانون في وقت لاحق في ديسمبر 2024، وهو الآن في انتظار النشر الرسمي في الجريدة الرسمية من قبل مجلس الحكام ليصبح ساري المفعول.
