I refer to Mr Kondogonis’ email to the Court below sent yesterday afternoon. On 4 December 2015, our client’s application pursuant to section 24X of the Prevention of Cruelty to Animals Act 1986 (Vic) was set down for a contested hearing and the matter was adjourned for a lengthy period of time (just short of 8 weeks) to 28 January 2016 specifically for the purpose of providing Mr Kondogonis with enough time to prepare, including obtaining legal advice. In the circumstances, we have informed Mr Kondogonis that our client is ready to proceed with the hearing of the application on Thursday and does not consent to his request for an adjournment of Thursday’s hearing. We have informed Mr Kondogonis that we will oppose any application he makes to the Court on Thursday for an adjournment of the hearing. In preparation for Thursday’s hearing, we further enclose a further affidavit sworn by Inspector Lisa Calleja of our client which will be relied on by our client.
