Responding to legal threats, gag orders, and workplace retaliation directed by Mayor Victorino, Supervising DSA Inspector Derek Hyland has resigned.  

Following his commitment to enforcing existing County Codes consistently with no favoritism, Inspector Hyland issued two Stop Work Orders that expose how Greg Brown misrepresented his building plans to unlawfully get an SMA Permit Exemption, denying the community of our rights. 

Inspector Hyland also exposed false public statements from Planning Director Michelle McLean about plan alterations that could allow construction to resume.

Napili resident and attorney Josh Downer announced that he is appealing to the Planning Commission determinations by Director McLean that clearly show favoritism to Brown, and will be filing for a court injunction to block Director Mclean from reversing the Stop Work Orders until his appeals are taken up.

Attorney Downer has also noticed Mayor Victorino of impending suits that will name the County and the Mayor for refusing to invalidate Brown’s wrongfully acquired SMA Permit Exemption, as required by law.

NO COST TO THE COUNTY:
In 2011, a citizen’s complaint revealed that then-Mayor Alan Arakawa overstepped his authority to allow massive retaining walls to be built at Palama Drive and it ended up costing the County over $25 Million in settlement fees. 

Greg Brown won't be able to sue because the County Council responded to Alan Arakawa’s debacle with legislation in 2012 that holds a developer responsible for any plan misrepresentations, even after the County has approved them. 

It is now a matter of public record that Mr. Brown made many misrepresentations, and some say payoffs, to get as far as he has.  

NO GOOD DEED GOES UNPUNISHED:
Inspector Hyland’s determinations have also validated the claims made by Whistleblower Chris Salem, who as a member of the Mayor’s staff informed the Mayor of Brown’s violations back in April of last year, which has led to a lawsuit now filed against the Mayor for wrongful termination as retaliation against Mr. Salem for his service to the community.

Now with Mayor Victorino, like Alan Arakawa before him, actively and directly protecting code violations and fraud perpetrated by well-connected developers, their paid consultants, and a small group of corrupt County officials, at the public's expense, we surely hope our County Council today will enact further legislative fixes that stop this kind of thing from ever happening again.
