Supporting Injured Workers Against WorkplaceNL (commission Newfoundland and Labrador)

WorkplaceNL is the Injured Workers compensation commission in Newfoundland and Labrador.

The commission is suppose to follow laws to avoid unfair and unintended results.

I started this petition to help get support to ensure the Workplace injury commission in NL begins to follow the law.

They are suppose to have an application for loss of earnings for the injured worker and the form for reporting injuries for the employer.

For possibly 40 years the application has never existed.  And they use a form 6 where the injured worker is reporting an injury.

I know it is change.org but if we can get enough people to understand how the commission is breaking the law from the minute an injury happens then things will change.  If we get change in NL, it will hopefully spread across the country!

More information about our particular situation below:

My husband had a recurrence of his Jan 2018 knee injury on Aug 5, 2019.  The commission refused to follow Section 19(4), Section 80(2), Section 19(1)(g) and policy EL-01 exceptional circumstances.  The decision they made forced us out of our rental home and across the country to live with family.  We have 3 children they disrupted the lives of.  

The commission further broke the law when they learned of the results of their decision being a move across the country. Under Section 64, the commission was suppose to immediately address the unintended and unfair results their decision caused and compensate based on the real facts of the case before them [also covered by Section 19(4)].

It has been 4 years of telling them we know this is illegal.  4 years of financial struggles.  4 years of medical neglect as well.  

The commission is 100% NOT TO BE TRUSTED!

And my proof is that as per Section 55, the injured worker applies for loss of earnings and medical aid while providing medical documents to prove the injury.

The commission claims they need a form 6 completed and signed by the injured worker.  Form 6 is forcing the injured worker to report the injury.  Section 56 is where the commission is told that only the employer reports the injury.  

The commission has never supplied an injured worker with an application as per Section 55.

Please sign this petition to at the very least show your support for the law to be followed!  For my husband to be legally compensated and for the inhumane and unethical way the commission has treated my husband and my family to never happen to another family!

Your support could start the beginning of a better program for ALL CANADIANS!  

The Act in Newfoundland and Labrador is PERFECTLY written!  It just needs to be PERFECTLY applied by competent, loving, compassionate, humans who actually care about not causing unfair and unintended results for injured workers.

Section 19(4) also states that a decision does not have to follow strict legal precedent!  This means that if even the 85% max compensable for the loss of earnings is going to cause an injured worker ANY form of unfair results, the commission has to work outside the act and compensate up to 100%.  

PLEASE HELP IN HOLDING THEM ACCOUNTABLE!

God is the God of making possible that things we believe to be impossible!

I happen to believe this is possible and 100% guaranteed with God by my side this whole time!  God needs others to believe this can be done by showing me your support!
