The Commission on Judicial Performance doesn't work swiftly on the thousands of complaints it receives related to California judges each year. But when one of those complaints is lodged by the Santa Clara County DA's office , the results appear to be better.
Just one year anniversary of an exparte communication in a criminal case, a public admonishment was handed down to Santa Clara County Judge Scott for his conduct, and effort to cover it up.
It is probably not enough. The judge lawyered up and likely will just be more careful who he hits on in chambers in the future. CJP should have removed this judge and sent a message to all judges. It is a missed opportunity and reinforces the problem absolute immunity creates in the American legal system.
We urge CJP to look far beyond Scott at the Santa Clara Family Court Judges, who engage in this type of conduct as a matter of routine.
