Family law judges seem to think they are above state and federal laws. In a courtroom again yesterday , Judge Grilli denied a self-represented man fees to fight to restore visitation and custody with his children after a mother ignored Grilli's orders to look for work in California. The father's due process rights were violated when he was forced to proceed in a week long trial and act as his own attorney to get his children and custodial time back. Grilli had ignored the father's exparte request for attorney fees to be represented at that trial, and then on 10-29-2014 told the father that his motion for fees was now moot . For the father who clearly was prejudiced and lost time with his children, he doesn't see it that way , and neither does due process. On the same morning, Judge Grilli seemed to be trying to bend over backwards to help a Russian father see his child, whom the mother had moved here. In that case Grilli had even used tax payer dollars to employ her research attorney to address international jurisdiction issues. Does Judge Grilli work harder for Russian fathers than she does American ones? The difference was the Russian father had a lawyer and wasn't even present. We have seen in case after case in Santa Clara Family Court that judges are bias against self- represented parties. That the parent who can't afford a lawyer is harmed on property, support and custody issues. The State Legislator has told our family courts this can't be done. Judicial Performance has told our judges to stop this, yet Judge Grilli and Santa Clara County seem to believe they can do what they want. Maybe they are reading Russian laws.
