The Issue

Our Appeal
We, members of the Indian community living and working in Poland, respectfully request the support of the Embassy of India in Warsaw regarding the growing number of tax notices being issued to Indian married couples concerning joint tax filings made in previous years.

This is no longer an isolated individual tax matter. It is affecting a significant number of Indian families across Poland and has become a broader community issue requiring institutional engagement.

Why We Are Concerned
Many Indian families:

  • Have lived and worked in Poland for years.
  • Have filed taxes openly and honestly.
    Declared their marital status correctly.
  • Used official tax systems.
Relied on Polish tax consultants, accountants, payroll specialists, and available guidance.
  • Had no indication that additional documentation relating to foreign matrimonial property regimes would later be required.
  • Years later, taxpayers are being asked to provide documents that may not exist under Indian law or may be difficult to obtain retrospectively.

Why This Matters
Many affected individuals are:

  • Highly skilled professionals.
  • Employees of international companies operating in Poland.
  • Long-term residents contributing to the Polish economy.
  • Parents raising families in Poland.
  • Taxpayers contributing income tax and social security contributions every year.
  • We came to Poland legally, through employment opportunities offered by Polish and international employers, and have contributed to Poland's economy and society.

The Impact on Families
Many households now face:

  • Uncertainty regarding tax filings accepted in previous years.
  • Possible reassessments covering multiple tax years.
  • Potential repayment demands relating to earlier tax returns.
  • Additional financial pressure on families with children, mortgages, rent obligations, and other commitments.
  • Families planned their finances based on accepted tax returns and information available at the time. It is extremely difficult for many households to suddenly absorb substantial financial liabilities several years later.

Our Concerns
We respectfully believe that:

  • Taxpayers who acted in good faith should be treated fairly.
  • Requirements affecting foreign marriages should be communicated clearly and consistently.
  • Where documentation does not exist under foreign legal systems, reasonable alternative evidence should be considered.
  • Indian citizens should not face severe financial consequences because of differing interpretations of legal concepts between two countries.

What We Request From the Embassy of India
We respectfully request the Embassy to:

  • Engage with the relevant Polish authorities on behalf of affected Indian citizens.
  • Seek clarification regarding the treatment of marriages governed by Indian law for Polish tax purposes.
  • Facilitate dialogue between the Indian community and Polish institutions.
  • Support efforts to achieve clear and consistent guidance for Indian families living in Poland.
  • Help ensure that Indian citizens who acted honestly and transparently are treated fairly.

Our Message

  • We are not asking for special treatment.
  • We are not seeking to avoid our legal obligations.
  • We support compliance with Polish law and wish to cooperate fully with the authorities.
  • We are simply asking for clarity, legal certainty, proportionality, and fair treatment for Indian families who have lived, worked, paid taxes, and contributed to Poland in good faith.
  • We respectfully ask the Embassy of India in Warsaw to raise this matter with the appropriate Polish authorities and help find a practical solution for affected Indian citizens.
