

After a grueling two-and-a-half-year legal battle, justice has finally been served! Judge Paige Reese Whitaker delivered a decisive default judgment against a corrupt HOA board that employed every delay tactic and legal maneuver to evade accountability. The defendants consisting of Clare (Clair/Clara) Cherry, Revonna Mitchell, Abebe Abay, and Greg Bell (who was illegally appointed to the board) engaged in systematic abuses of power, stripping homeowners of their rights, dignity and even their safety.
The court’s ruling is a resounding victory for transparency, accountability, and homeowner rights. The judge ordered the following:
- Judicial Removal – The corrupt HOA board members are officially removed from their positions.
- Financial Restitution – The defendants must reimburse the plaintiff for damages and legal fees incurred due to their misconduct.
- New Leadership – Michael Shepherd has been placed on the board to help restore integrity to the HOA.
- Full Transparency – The defendants are required to hand over ALL necessary HOA documents to the new board members within 30 days, ensuring a smooth transition and preventing further obstruction.
This case highlights a much larger issue: HOA board abuse is rampant, and homeowners often have little recourse against unchecked power. Many families face harassment, predatory fines, wrongful liens, and even foreclosure due to the actions of overreaching or corrupt HOA boards. The system is broken, and legislative reform is urgently needed to protect homeowners from these injustices. It is absolutely unacceptable that an owner needs to spends $40,000 to get justice because an HOA board refuses to not only follow the bylaws and state laws but go out of their way to run a criminal enterprise and abuse their power as they refuse to step down despite being voted out.
Because of my experience, I will explore launching a 501(c)(4) organization to provide HOA education to both boards and owners and help support campaigns in Georgia to combat this systemic problem. The focus would be:
- Raising awareness about HOA rights and obligations in Georgia.
- Advocating for legislative reforms that curb HOA abuses, increase transparency, and protect homeowners from predatory practices.
- Raising campaign funds to support politicians who will author and champion laws that hold HOA boards accountable.
The mission is clear: No more families should lose their homes or suffer under the tyranny of unaccountable HOA boards. By mobilizing grassroots support, lobbying for stronger laws, educating home owners on what they need to understand when they purchase an HOA home and financially backing candidates who prioritize HOA reform, we can create real change.
