

This upcoming Monday, February 3, 2025, at 11 am ET in Fulton County Superior Court (185 Central Ave, Atlanta, GA) under Judge Paige Reese Whitaker (5D), the Peyton Place Condominium community which includes myself will finally get to state our grievance during a default judgment hearing against Claire (Clare/Clara) Cherry, Revonna Mitchell, Abebe Abay and the newly illegally appointed HOA officer Greg Bell. It is a default hearing since they ignored and refused to respond to the court until this past week in which they are attempting to get the case dismissed based on false information to when the lawsuit was filed and procedural grounds which they appear to be mistaken on.
It has cost me $30,000 in legal fees and counting to get any relief with the ongoing issues. It is downright despicable that in order to get your own condo association to follow state law/bylaws and prevent your property from calamity your only solution is to somehow come up with the funds yourself in order to get enforcement. I have reached out to politicians both local and state, government and law enforcement officials with absolutely no reprieve other than to sacrifice myself to be bled dry financially in order to get resolve for this case. It should not have been allowed to get this far! We need enforceable HOA oversight!!!

As a reminder, the lawsuit is based on some of the following facts:
- HOA Board admission of diverting HOA funds into private bank accounts.
- Requesting hoa fees in cash and not providing receipts.
- Failure to collect HOA dues regularly.
- Failure of HOA board to pay HOA fees making them ineligible to be on the board.
- Failure to provide legally required insurance for the building structures.
- Failure to hold board meetings and member meetings.
- Failure to provide documents required under law in order to process real estate transactions.
- Failure to provide the HOA budget and expenditures.
- Failure to make repairs causing roof leaks, mold, and other hazards.
- Illegal HOA board appointments.
- Failure of the HOA board in virtually every element of their responsibilities.
