The Issue
In this country there are an estimated 120,000 innocent people currently in prison. My husband, Vincent Flores, Jr. was sent to prison on September 13, 2018.
On May 2, 2017 our adopted daughter made false allegations against her father and this started a whirlwind of events. I was recovering from having been in the hospital for a month in December, 2016 due to a coma induced because of major blood clots in my brain. A call came in from my husband stating that regional (that is what the police department is called in Monroe County Pennsylvania) had claimed there was a problem with our children and that he was to follow the officer to the department. My husband had asked if the children were okay? We had adopted four siblings, 2 boys and 2 girls. Ages 13, 12, 10, & 8. We have our own biological son, 16. We called ourselves the Flores Family 7. We couldn't even imagine what it could have been. I had not yet been cleared to start driving. My husband had been doing everything since I was brought back from the hospital. He was doing the cooking, laundry, making sure I was taking all of my medications, having to give me my injections. Our children were also helping out much as they could. They love being involved. My husband is a caring, affectionate, loving and understanding father and husband. We have been married for over 33 years. God blessed us with a son after struggling to conceive for 17 years. When my son started asking for more brothers and sisters we started talking about fostering children. On November 8, 2013, four siblings came into our lives. They came from a home of abuse, neglect, filth and parents using drugs. They had been exposed to things that children should not have been exposed to. During the time they were still our foster children, their biological father had committed suicide. Till this day no one knows why. These beautiful children had to endure things we as parents could not comprehend. We did not want them to be separated. Family is very important to us, so we decided to take them all.
Our children were adopted by us on September 28, 2015. They changed their names and life was good. My husband was the provider and had his own business with plumbing, heating, & electrical work. The kids would go to school and I was the homemaker. My children were very well taken care of. They were always fed and had their own rooms and activities. We always did things as a family. Trying to instill in our adopted children some type of normalcy, structure, stability, affection and love. We truly believe something did happen to our daughter and it could have been some sort of "Transference."
Well on the day of May 2, 2017 things dramatically changed for the whole family. My husband was brought in for questioning and was told he could not return to the home because of the allegations our daughter made against her father. He told me to go home with the children and he would find somewhere to go until the situation was taken care of. He didn't want our children to be removed from the home. Every day after, the police officer at my daughters school would pull her out of her classes to constantly speak to her. No one at the school every notified me of this and my daughter is a minor. My daughter continued to change her story and add to it. That officer gave my daughter a portable PlayStation gaming system and my daughter hid it from me. She had told that officer she had nothing to do in the house. At the time, she had a whole closet full of things to keep her occupied. So when I found it in my daughters book bag, I removed it and brought it straight away to Regional and put a complaint in regarding that officer. Was this office coercing my daughter? I found out she was telling my daughter that she wish she could adopt her. This is acceptable behavior in the commonwealth? I do not agree. Soon after our daughter was removed from our home by Children and Youth Services. My husband was not allowed any sort of contact with his children who love him dearly. It broke his heart. They miss him so much!
He was later arrested and his sister and myself helped him to post bail. He had to stay with his sister until his trial. It took 14 months before his trial was scheduled. Fourteen months of no contact with our children. He hired an attorney who took his case. The commonwealth had put 25 charges against my husband. We had evidence that could have deemed a different outcome. A Motion In Limine had been submitted to the court.
During his trial, our daughter gave her testimony that did not match her previous allegations and her story continued to change. Then the teacher who wrote what she alleged, along with the guidance counselor as well as the police officer who works at the school (the one who gave my daughter the gaming system) and the detective, forensics and Children & Youth of Monroe County. Then my husband was put on the stand. Two of our children also testified on behalf of their father. We had evidence about our daughter's past involving allegations against others in other homes, which she had patterns of these allegations everywhere she goes. That evidence was not allowed. Not any of it. It was extremely relevant to my husbands case. His attorney did not make any objections when the DA was basically portraying my husband as some sort of monster. It was very frustrating. His attorney basically left my husband to defend himself. He should have fought for my husband. He did not. All along telling my husband he knew what he was doing. He said things were looking in our favor. Then nearing the end of the trial he mentions it could go either way. How can you defend someone when you allowed the Judge to throw out your evidence? When the verdict came back guilty and I returned home that evening, I had to break the news to our children. They were very emotional knowing their father would not be coming home. Of the 25 charges only 7 had verdicts. All the DA had was circumstantial evidence and our evidence was thrown out. As long as they obtain a conviction it doesn't matter whose life gets destroyed. Isn't the criminal justice system there to protect the innocent and seek the truth? Well in this matter the system made its decision as soon as my husband had been arrested. I truly believe had my husbands evidence been allowed he would be back home with his family where he belongs!
Our Constitution allows the right to a fair and impartial trial. Do you see this as fair? Now my husband is looking at 4 to 5 years in prison. By the time he is released our oldest child will be in his early 20s and the rest of our children in their late teens. Children need their Fathers in their lives. It does make a great impact on them. The irony of it is after 14 months of no contact with our children, Children and Youth now allow our children to visit their father while he is incarcerated.
We ask that the Superior Court of Pennsylvania allow the evidence to be submitted, reviewed and a decision of INNOCENT on all counts made on behalf of my husband Vincent Flores Jr's case. We win this and from now on people who have evidence would be allowed to submit it for their defense especially if its relevant to your case and the rest of your life!
All this took place in Monroe County, Pennsylvania.
We need help finding a lawyer that will fight for my husband. We were caught by surprise and now the business has suffered. There aren't any calls coming in so our funds are decreasing and it is making it more difficult to manage as a single parent. The weather is getting colder and heat is limited. I'm doing the best I can to maintain our house. The bills are continuing to pile up and the calls are nonstop. Everyone doesn't want to hear you don't have it right now, give me a chance to figure it out.
The holidays are now coming and it's not going to be the same. I feel like I'm drowning. How can you be thankful when the world you know is now slowing becoming obsolete and you're trying to hold your head above the water. I'm trying to be strong for my kids and pretend that everything is okay. Now my 16 year old has to take on the father figure for the younger ones. He is feeling overwhelmed as it is. His anxiety level is manifesting itself where his emotions are out of whack. I try to tell the kids this is what we have right now, ourselves. We have to try and be strong for one another.
I am trying to find all types of resources for help and I am not getting any responses. Donations with food, clothes, cost of living, lawyer fees. Anything will help.
