Stronger Restrictions on AI-Generated CSAM

The Issue

At this given moment, December 9 2025, there are currently not ENOUGH restrictions on AI-generated content that involves characters under 18 in the United States. AI can easily generate sexual images, videos, or lewd positions of any victim who's face is inserted into the machine - whether it be from a screenshotted post online or an image taken of an individual. 

There are currently 5 states that do not enforce a restriction on AI-generated content regarding children. These states being: Alaska, Colorado, Massachusetts, Ohio, and Vermont. Alaska, Colorado, Massachusetts, Ohio, will not add it because it does not fall under the direct term of child sex abuse material. Vermont will not add it because they clearly and simply state, "No person may, with knowledge of the character and content, promote any photograph, film, or visual recording of sexual conduct by, with, or on a child, or of a lewd exhibition of a child’s genitals or anus. This subsection does not apply to paintings, drawings, or to nonvisual or written descriptions of sexual conduct." (Vermont, “§ 2824a) There is absolutely no reason that these alone should be what is preventing a restriction towards child sex abuse material that is AI-generated. Everyday, there is exploitation whether it be happening physically or generated, AI machines get the faces from somewhere. Children are becoming victims without the knowledge of them or their guardians. Protect our children.

Child sex abuse material is portrayed media of sexual abuse towards children regardless of if the actions in the content were physically acted upon or not to the child(ren) portrayed. Generated content of it is generated as a warp to detour past laws in certain areas or states, and is generated for the same reason that the content is physically created. "Child sex abuse material" is defined as, "...used in federal statutes and is defined as any visual depiction of sexually explicit conduct involving a person less than 18 years old." Which is the definition and terminology stated by justice.gov.

When it comes to defending and saving our children, morality needs to be planted first if we truly want them to stay safe. If you see something, report it.
