Dear U.S. Department of Justice,

 

I am writing as a concerned citizen to respectfully request that the Department of Justice and the Second Amendment Task Force review and support the ongoing federal case Vallejos v. Rob Bonta & Chad Bianco, which challenges the constitutionality of California’s Concealed Carry Weapon (CCW) permit scheme.

 

This case, filed by David Phillip Vallejos, exposes how California’s CCW framework allows local sheriffs to deny law-abiding citizens the ability to exercise their Second Amendment rights based on subjective moral standards, arbitrary discretion, and excessive financial barriers. Despite the Supreme Court’s clear ruling in New York State Rifle & Pistol Association v. Bruen (2022), which prohibits such discretionary restrictions, state and county officials continue to defy that precedent.

 

The Riverside County Sheriff’s Department, under Sheriff Chad Bianco, has been specifically named for using biased and subjective standards to deny permits, even when applicants have been cleared by the California DOJ. These unconstitutional practices not only violate Bruen but also the Equal Protection Clause and Due Process rights guaranteed by the U.S. Constitution.

 

Mr. Vallejos’ lawsuit directly challenges this abuse of authority and aims to restore the right to bear arms as an inalienable right—not a privilege sold through arbitrary licensing. A victory in this case would reaffirm Bruen nationwide, potentially paving the way for constitutional carry protections across the United States and ending discriminatory “may-issue” systems once and for all.

 

We respectfully urge the DOJ and the Second Amendment Task Force to:

 

1. Review the merits of Vallejos v. Bonta & Bianco;

 

 

2. Consider providing federal oversight, legal support, or amicus participation; and

 

 

3. Ensure that California’s agencies comply with federal constitutional standards and Supreme Court precedent.
