『 STRAIGHT EDGE という思想・歴史的背景を軽視し、特定の企業が独占する"商標登録"に反対』

2026年4月13日、「STRAIGHT EDGE」というアパレルブランド (代表：廣江 一也氏、CNO：西野 亮廣氏) が始動するというWebニュース内で「STRAIGHT EDGE」が商標出願されていることを把握しました。

我々は「STRAIGHT EDGE」という言葉が、特定の企業によって独占されるべきではないと考えます。
これは商標法の趣旨に反し、文化の私物化を招くものだと強い懸念を抱いています。
つきましては、商標登録への異議申し立てを行うことを前提に、署名活動を始めます。

STRAIGHT EDGEという思想の実践を伴わない企業が、商業的にその名を利用し独占を図ることは、40年以上にわたり先人たちが築き上げてきた文化の本質を汚し、その精神的な価値を根底から損なう行為です。それは単なる名称の使用ではなく、文化への冒涜及び衰退や崩壊へ招く破壊行為と言えます。

また、我々が属するハードコア・パンクコミュニティ内で、アパレルブランドSTRAIGHT EDGEの展示会へ足を運んだ方や、代表者と直接コンタクトを取っている方がおられる現状を把握しております。
しかし、未だ商標登録の取り下げや名称変更などの正式な声明は出されていません。

この現状を踏まえ、異議申し立ての際に効力となる "署名" を集いたいと思います。

この署名で抗議の声を可視化し、その声が大きければ大きいほど登録抹消の可能性が高まります。

• 「STRAIGHT EDGE」とは

1980年代初頭にワシントンDCのバンド ”MINOR THREAT” のボーカル、Ian Mackaye氏が最初に提唱した既存の価値観へのアンチテーゼとして、ドラッグ・アルコール・煙草・快楽目的の性行為などを拒否する禁欲的な考え方であり、それを貫くライフスタイルのことです。

 

 

ハードコア・パンクという音楽ジャンルから派生した生き方のひとつであり、以降影響を受けた支持者や実践者が数多く生まれ、様々な音楽や表現で文化的醸成がされてきました。今なお、STRAIGHT EDGEのライフスタイルを実践するアーティストやコミュニティは、世界各地で世代を超え受け継がれています。

また、STRAIGHT EDGEのライフスタイルを実践していない者は、STRAIGHT EDGEを名乗ることはありません。
それは、STRAIGHT EDGEのことを知る者は、そのライフスタイルを理解し尊重しているからです。
今回の件は正に、言葉や文化、実践している人々を軽視しているという他ありません。

 

 

人々の生活や表現活動と深く結びつく文化や歴史を軽視し、その言葉を独占し商標登録することに、強く異議を唱えます。
本署名は、特許庁に対し当該商標の登録取消しを求める「登録異議の申立て」の重要証拠として提出されます。

• 商標登録の現状について

この商標の現在のステータスは、登録査定は既に完了しており登録公告前の状態です（※追記：今回のニュースが流れた後の4/20付で、さらに登録料も納付され、実際にステータスは進んでいることを確認しています）。情報提供という形で意見を提出する事はできますが、登録査定は既に完了しており、その情報提供は審査官が確認する事は無く受理のみになります。

我々はそれらの現状を受けて、審査のステータスが更新され、商標登録が完了した際に「異議申し立て」を行うのが最善と判断しました。異議申し立ての手続きが可能な期間は、商標が登録完了し、商標掲載公報が発行されてから2ヶ月以内です。

これらを踏まえ、現段階で出来るアクションとして、
"オンライン署名"  を集います。

署名で抗議の声を可視化し、異議申し立ての際に、証拠の客観性を伴う事実として活用させていただきます。
その声が多いほど効力は増し、商標登録が抹消される可能性が高まります。
この署名でなくとも、個別に異議申し立てを行なっていただき、その数を増やしていけたら幸いです。

• 反対の根拠について

今回の法的論点は以下となります。

1．公序良俗違反（商標法第4条第1項第7号）
「STRAIGHT EDGE」の思想を共有しない、あるいは相反する者が商業的利益のために本用語を独占することは、信条を持つ人々への尊厳を傷つけるものであり、社会通念上、公序良俗に反する登録（文化的転用）に該当します。

2．混同惹起商標（商標法第4条1項15号）
本用語はアパレル分野においても、特定の思想やムーブメントへの帰属を示す「属性表示」として定着しています。無関係な第三者が本商標を使用することは、消費者が「この製品はストレート・エッジの思想に基づいたものである」あるいは「特定のムーブメントと関係がある」と出所を誤認混同するリスクを恒常的に生じさせます。

3．識別力の欠如および自由使用の必要性（商標法第3条第1項第6号等）
「STRAIGHT EDGE」は、既に音楽・ファッション業界において、特定のスタイルを指す「一般名称」に近い存在となっています。誰か一人が独占することは、既存の表現者やコミュニティの正当な活動を不当に制限するものであり、公共の利益を損なうものです。

「STRAIGHT EDGE」という言葉は、「一般名称（Generic Term）」として認識されています。
過去に何度か出願されていますが、それらは、審査段階で拒絶（Refused）、または放棄（Abandoned）されています。

今回の商標登録に関する件は、瞬間的な感情だけではなく、先述してきたような文化的・歴史的背景や、古くから現在に至るまで「STRAIGHT EDGE」の信条を基にして活動するバンドがいること、ライフスタイルとして実践する方々がおられること、そしてそれらの言葉や表記、作品、マーチャンダイズなどの表現が制限される可能性を危惧しています。

 

 

この署名が集まりましたら、本プロジェクトを通じた特許庁への異議申し立ての際に、証拠物、上申書・理由書（公序良俗違反／商標法第4条1項7号、混同惹起商標／商標法第4条1項15号、識別力の欠如／商標法第3条1項6号）として活用させていただきます。

Petition: Opposition to the Trademarking of  “STRAIGHT EDGE” in JAPAN

・Core Statement

We oppose the trademark registration of "STRAIGHT EDGE" by a specific corporation, which disregards its profound ideological and historical significance.

・The Current Situation

On April 13, 2026, it was announced via web news that a new apparel brand named "STRAIGHT EDGE" (represented by Kazuya Hiroe and CNO Akihiro Nishino) has been launched. Upon investigation, we confirmed that trademark applications for "STRAIGHT EDGE" have been filed.

We firmly believe that the term "STRAIGHT EDGE" should not be monopolized by any single corporation.
This act contradicts the fundamental spirit of trademark law and represents an unjust "privatization of culture." We are launching this petition to gather support for a formal Notice of Opposition to revoke these registrations.

For companies that do not practice the Straight Edge philosophy to commercially exploit its name in an attempt to monopolize it is an act that tarnishes the essence of a culture built up by our predecessors over more than 40 years and fundamentally undermines its spiritual value. This is not merely the use of a name; it constitutes a desecration of the culture and an act of destruction that leads to its decline and collapse.

We are also aware that within the hardcore punk community to which we belong, there are individuals who have attended the STRAIGHT EDGE apparel brand’s exhibition or who are in direct contact with its representatives.
To effectively challenge this at the Japan Patent Office, we need to visualize our collective protest through this petition.
The louder our voice, the higher the possibility of cancellation. If you stand with us, please sign and share.

 

・What is "STRAIGHT EDGE"?

Coined in the early 1980s by Ian MacKaye, vocalist of the Washington D.C. band MINOR THREAT, "STRAIGHT EDGE" began as an antithesis to prevailing social norms. It is a philosophy and disciplined lifestyle centered on the refusal of drugs, alcohol, tobacco, and promiscuous sex.

Originating from the hardcore punk subculture, this way of life has inspired countless adherents and practitioners worldwide. Over decades, it has evolved into a rich cultural heritage expressed through music and art, passed down through generations of artists and communities globally.

Crucially, those who do not practice the lifestyle do not claim the name "STRAIGHT EDGE."
This is because anyone who understands the culture respects the weight it carries.
This trademark filing is a blatant disregard for the language, the culture, and the people who live it every day.
We strongly oppose the monopolization of a term so deeply tied to people's lives and creative expressions.
This petition will be submitted to the Japan Patent Office as crucial evidence for our Request for Revocation.

・Current Legal Status

The trademark has already passed its initial examination (Notice of Allowance) and is currently in the stage just before official publication (Note: As of April 20, following the release of this news, the registration fee has also been paid, and we have confirmed that the status is indeed progressing.) . While "Information Provision" is possible, at this stage, it would only be acknowledged and not re-examined by the examiners.

Therefore, our best course of action is to file a Formal Opposition once the registration is completed and published in the Trademark Gazette. The window for filing an opposition is strictly limited to two months following the publication.

As an immediate action, we are gathering these online signatures. This will serve as objective evidence of public outcry and "Likelihood of Confusion" when we file our legal challenge.

・Legal Grounds for Opposition

1. Violation of Public Order and Morality (Trademark Act Article 4, Paragraph 1, Item 7) The monopolization of "STRAIGHT EDGE" by those who do not share—or even act contrary to—its core tenets for commercial gain is an affront to the dignity of the community. In a social context, this constitutes "Cultural Appropriation" and violates public order.

2. Likelihood of Confusion (Trademark Act Article 4, Paragraph 1, Item 15) In the apparel sector, this term is firmly established as an "indicator of identity" and affiliation with a specific movement. Use by an unrelated third party creates a constant risk that consumers will mistakenly believe the products are "official merchandise" of the Straight Edge movement or have some formal affiliation.

3. Lack of Distinctiveness and the Need for Free Usage (Trademark Act Article 3, Paragraph 1, Item 6) Within the music and fashion industries, "STRAIGHT EDGE" has become a generic term used to describe a specific style/philosophy. Allowing a single entity to monopolize it unfairly restricts the legitimate activities of existing artists and the community, harming the public interest.

・Current Status at the United States Patent and Trademark Office (USPTO)
The term “STRAIGHT EDGE” is recognized as a “generic term.”
Although applications have been filed on several occasions in the past, they have been refused or abandoned during the examination process.

In addition to signatures, we are collecting images and scans to serve as "Proof of Prior Use" and "Evidence of Establishment."

・Final Word

This opposition is not merely an emotional reaction.
It is about protecting a cultural and historical legacy.
We fear that the activities of bands and practitioners who have lived by the "STRAIGHT EDGE" creed since the 80s will be restricted by this trademark.

Upon completion, these signatures will be used as evidence in our legal filings (Statement of Reasons for Opposition) to protect our underground music culture.
