The Issue

 
Description: My name is Paul, and I am deeply concerned about a significant safety issue that is unfolding on Stone Church Road in Hamilton, Ontario. A residential property owner at 786 Stone Church Road has cut the city guardrail without proper permits, and is in the process of constructing a driveway from their property onto an unsuitable portion of the road.

Yes, everyone needs places to live.  Yes there are houses across the road.  However, all subdivisions and houses are accessed via Upper Horning Dr, and there have been no driveways permitted on this stretch of road for over 30 years (until Bill 23 was recently misused as an excuse for this current site)

This disregard for established road safety norms is not just alarming and sets a dangerous precedent, but it generates significant risk to all road users. This stretch of Stone Church Road between Upper Horning Rd. and Golf Links road is very fast moving, and the abrupt existence of a driveway at an unsuitable point will surely catch drivers off guard and could potentially lead to serious collisions.

According to the Transport Accident Commission, in 2019, driveway accidents were responsible for a significant percentage of accident-related injuries in urban areas (Transport Accident Commission, Victoria, 2019). The ill-placed driveway isn't just risky; it's a compromise on the community's collective safety.

On top of these public road safety concerns, the forested area this property falls within, is part of a larger patch that is almost entirely protected by Hamilton Conservation Area (as the Tiffany creek headwaters, a provincially significant wetland, and one of the few left in the area). 

Many threatened and endangered species have been found in this area.  Proper due diligence and updated Environmental Assessments have not been completed.  City owned roadway shoulder trees were not marked and protected prior to the rogue construction began, and as a result the entire patch has been clear cut.

Our community's safety should be the primary concern for any such construction decisions, and I urge the Hamilton City Council to take necessary actions.
