We, the undersigned residents and property owners of Idaho, call on the legislature to protect our communities from the unfair practices of unlicensed contractors by implementing clear checks and balances that prevent them from filing mechanic’s liens without proper verification.

The Problem: Currently, Idaho law allows anyone to file a mechanic’s lien without requiring the county clerk to verify the validity of the lien or confirm the contractor’s licensure. This lack of oversight creates a significant loophole that:

 • Enables unlicensed contractors to file liens, even if they deliver substandard, incomplete, or unsafe work.

 • Forces homeowners and property owners into costly and time-consuming legal action to resolve disputes.

 • Puts property owners at risk of financial hardship while rewarding unethical and illegal practices.

This absence of checks and balances unfairly burdens property owners, leaving them to fight legal battles over work that often does not meet state or industry standards.

Why This Issue Matters:

 1. Accountability and Consumer Protection:Licensed contractors in Idaho are required to meet specific standards, including bonding, insurance, and quality regulations. Unlicensed contractors bypass these safeguards and still have access to a powerful legal tool—the mechanic’s lien.
