Stop Unethical HOA Practices and Protect Resident Rights
The Issue
We, the residents of the Ashley Park Community in Rock Hill, SC, USA sharing this personal story, have found ourselves amid a confrontation with our Homeowner's Association (Ashley Park HOA of Rock Hill). Despite the absence of restrictions or prohibitions regarding utility trailers in our bylaws, our HOA has unreasonably demanded that we remove our utility trailer. It is important to note that the violation cited by the HOA does not align with their claim, portraying a lack of both justice and fairness.
Reportedly, HOA's rules and regulations should only be enforceable if they are explicitly stated in the bylaws (Source: Community Associations Institute). This instance, therefore, sets a disturbing precedent of arbitrary enforcement of non-existent rules, gravely undermining the confidence and trust of residents in the HOA's authority.
Roughly 63 million Americans live in areas with a homeowners association, and among the common issues they face, “rule enforcement” ranks near the top. The issue resonates nationwide. It is not an isolated incident (Source: Foundation for Community Association Research).
We categorically demand that the HOA cease attempts to enforce rules not stipulated in the bylaws, review their behavior in light of the fundamentals of justice and fairness, and restore the faith of residents in their authority.
