Recently, the California Department of Housing and Community Development (HCD) issued a Notice of Violation (NOV) to the City of Roseville for non-compliance with the Surplus Land Act (SLA). Additionally, the HCD may notify the Office of the California Attorney General that this violation has occurred.
This violation pertains to the city's proposed disposition of approximately 236.26 acres of farmland located at 6382 Phillip Road in Roseville, California. This Property is known as the “Phillip Road Site”.
The HCD found that the City of Roseville “violated the SLA by selecting a developer in 2020 and entering into a PSA (Option and Purchase and Sale Agreement) without first complying with the requirements of the SLA in place in 2020. Since then, the City failed to take the necessary steps to come into compliance with
the SLA by either issuing an NOA (Notice of Availability) to all required entities or declaring the property ‘exempt surplus land.’”
The City has until February 4, 2024 to cure or correct these violations. If this is not done and the City moves forward with the sale of this Property, a penalty of 30% of the final sales price would be assessed (currently in escrow with Panattoni Development for $8.8 million) and the City could face additional actions pursued by the HCD. Meanwhile, the HCD has urged the City to suspend any further actions to dispose of the Property. According to HCD enforcement records, Roseville is only the fourth city to receive such a violation.

What can local Roseville residents do?
We encourage you to email City officials and let them know we object to Roseville taxpayer dollars being used to pay the 30% penalty for selling this property without correcting the HCD violations noted. We also need to remind them that we have and continue to oppose Industrial Re-zoning and the development of an Industrial
Park on this property!
