The Issue

MALAYSIA IS WATCHING: This is no longer a trial, it is a violation of human rights.

Three years ago, Patrick Khoo (fondly known as Uncle Khoo) stood up to protect the voiceless. On the night of March 22, 2023, while at his own factory premises, he witnessed a harsh stray dog-catching operation conducted by the Petaling Jaya City Council (MBPJ). He didn't use violence—he used his presence to shield the animals he cared for. In return, he was struck across the face with a metal loop pole by an enforcement officer, leaving him with documented injuries to his jaw and wrist.

Today, the victim has become the accused. Despite the CCTV footage showing provocation and physical abuse by the officers, Uncle Khoo is the one being dragged through an unnecessary three-year legal battle under Section 186 of the Penal Code.

A Humanitarian Crisis, Not Just a Legal Case
The three-year drag of this case has done what the initial incident could not, it has broken Uncle Khoo’s health. Since the case began, Uncle Khoo has suffered multiple strokes and a total physical collapse. He is now non-ambulatory, wheelchair-bound, and resides in a nursing home requiring 24-hour specialised care. His cognitive decline is so severe that he can no longer remember much, let alone the details of the traumatic incident or provide clear instructions to his lawyers.

Why This Trial Must End NOW

  1. It is Oppressive and Unconscionable: Forcing an incapacitated stroke survivor to stand trial for a minor, three-year-old offence is a form of state-sanctioned cruelty.
  2. No Public Interest: Prosecution policy dictates that the law should not be used to crush the frail and elderly for summary offences. The state gains nothing by convicting a man in a nursing home.
  3. Abuse of Process: The legal system, meant to protect the vulnerable, has instead become the instrument of Uncle Khoo’s physical and mental decline.


Our firm and kind request to the Attorney General of Malaysia:
We, the undersigned, strongly urge the Attorney General’s Chambers (AGC) and the Honourable Court to exercise their discretion under Article 145(3) of the Federal Constitution and Section 254 of the Criminal Procedure Code to:

  • Review, refine, consider, and immediately discontinue all charges against Patrick Khoo.
  • Grant a Discharge Amounting to an Acquittal (DAA) on humanitarian and procedural grounds.

Uncle Khoo defended the innocent lives of God's creation. Now, it is our turn to defend his human rights to live his remaining days in peace. He has already "served" a sentence of three years of extreme psychological stress that has stolen his health and dignity.

Sejak kes ini bermula, Uncle Khoo telah mengalami serangan strok berulang kali dan mengalami kejatuhan tahap kesihatan fizikal yang total. Beliau kini tidak mampu bergerak sendiri, terlantar di kerusi roda, dan menetap di rumah penjagaan yang memerlukan jagaan pakar 24 jam. Kemerosotan kognitifnya sangat serius sehingga beliau tidak lagi mampu mengingati butiran kejadian atau memberikan arahan yang jelas kepada peguamnya.

Mengapa Perbicaraan Ini Mesti Dihentikan SEKARANG:

  1. Ia Menindas dan Tidak Munasabah: Memaksa seorang mangsa strok yang terlantar untuk menghadapi perbicaraan bagi kesalahan kecil yang berlaku 3 tahun lalu adalah satu bentuk kekejaman yang direstui oleh negara.
  2. Tiada Kepentingan Awam: Polisi pendakwaan menetapkan bahawa undang-undang tidak sepatutnya digunakan untuk menghancurkan warga emas yang uzur bagi kesalahan-kesalahan ringan. Negara tidak mendapat sebarang faedah dengan menyabitkan kesalahan terhadap seorang lelaki yang kini di rumah penjagaan.
  3. Penyalahgunaan Proses: Sistem perundangan yang sepatutnya melindungi golongan rentan, sebaliknya telah menjadi instrumen kepada kemerosotan fizikal dan mental Uncle Khoo.

Permohonan tegas dan tulus kami kepada Peguam Negara Malaysia:

Our absolute focus is to stop the prosecution of a 71-year-old stroke survivor who is medically unfit to stand trial.

  • Constitutional Prerogative (Art. 145(3)): The Attorney General (AG) has the absolute power to discontinue this case. We are calling for a Discharge Amounting to an Acquittal (DAA) under Section 254 CPC. A mere pause (DNAA) is insufficient; Uncle Khoo deserves permanent peace.
  • Procedural Barrier (Section 342 CPC): Legally, a trial cannot proceed if the accused is "incapable of making his defense." Due to neurological decline from multiple strokes, Uncle Khoo cannot provide instructions to counsel. To continue is a breach of the Right to a Fair Trial (Art. 5 Federal Constitution).

  • Misfeasance in Public Office: Seek to prove the officer acted with "malice" or exceeded legal powers by using a loop pole as a weapon against a senior citizen.
  • Judicial Review: MBPJ to disclose SOPs, Training Records, and Duty Rosters through a court-ordered "Discovery" process.

A Call for Collective Interest
Pursuing a civil suit against a public authority like MBPJ is heavy on time, legal expertise, and financial resources. Under the Public Authorities Protection Act 1948, there is a strict deadline: Legal action must be filed by 22 March 2026(36 months from the incident).

The Current Game Plan: Sanity vs. Ego
Our immediate priority remains Part A: Securing a DAA (Discharge Amounting to an Acquittal) from the Attorney General and the Court. We are essentially asking the state to perform the radical act of "not being cruel" to a 71-year-old stroke survivor.

Once Uncle Khoo is legally safe from this over 1,000-day-long exercise in futility, we can pivot to the civil accountability phase. If the authorities find the court process "taxing," they should prepare for the alternative: a public that actually remembers. If the system continues to protect "gangster-like" ego over basic human dignity, the remedy is simple: Vote accordingly. In the next General Election, let’s save our ballots for those who can distinguish "good governance" from "ignorant injustice." If they cannot handle the weight of an SOP or the fragility of a senior citizen’s life, they certainly should n’t be handling the weight of administrating a nation or even a city.

A nation's strength is measured not by the ego of its administrators, but by their empathy and professional competence. We must now move beyond rhetoric and demand that these qualities become the baseline for public service.

It is vital for every supporter to understand the legal framework and the "two-front" battle we are facing.

Part A: The Criminal Case (Immediate Priority)  
Our absolute focus is to stop the prosecution of a 71-year-old stroke survivor who is medically unfit to stand trial.

  • Constitutional Prerogative (Art. 145(3)): The Attorney General (AG) has the absolute power to discontinue this case. We are calling for a Discharge Amounting to an Acquittal (DAA) under Section 254 CPC. A mere pause (DNAA) is insufficient; Uncle Khoo deserves permanent peace.
  • Procedural Barrier (Section 342 CPC): Legally, a trial cannot proceed if the accused is "incapable of making his defense." Due to neurological decline from multiple strokes, Uncle Khoo cannot provide instructions to counsel. To continue is a breach of the Right to a Fair Trial (Art. 5 Federal Constitution).
     

Part B: Accountability & Civil Action (The Long Game)
While the criminal case is the immediate priority, it is also laying the groundwork to hold MBPJ and the officers involved accountable for the "gangster-like" conduct evident in the CCTV recording.

  • Vicarious Liability: MBPJ is legally responsible for the wrongful acts (Assault, Battery, and Negligence) of its employees during their duty.
  • Misfeasance in Public Office: Seek to prove the officer acted with "malice" or exceeded legal powers by using a loop pole as a weapon against a senior citizen.
  • Judicial Review: MBPJ to disclose SOPs, Training Records, and Duty Rosters through a court-ordered "Discovery" process.

A Call for Collective Interest
Pursuing a civil suit against a public authority like MBPJ is heavy on time, legal expertise, and financial resources. Under the Public Authorities Protection Act 1948, there is a strict deadline: Legal action must be filed by 22 March 2026(36 months from the incident).

  • Private Property Limits: Enforcement entry into private premises generally requires specific authorization or a warrant unless there is an immediate threat.
  • Proportional Force: Any physical force used must be strictly proportional. The use of animal control tools on humans is a gross violation of SOP.


The Current Game Plan: Sanity vs. Ego
Our immediate priority remains Part A: Securing a DAA (Discharge Amounting to an Acquittal) from the Attorney General and the Court. We are essentially asking the state to perform the radical act of "not being cruel" to a 71-year-old stroke survivor.

Once Uncle Khoo is legally safe from this over 1,000-day-long exercise in futility, we can pivot to the civil accountability phase. If the authorities find the court process "taxing," they should prepare for the alternative: a public that actually remembers. If the system continues to protect "gangster-like" ego over basic human dignity, the remedy is simple: Vote accordingly. In the next General Election, let’s save our ballots for those who can distinguish "good governance" from "ignorant injustice." If they cannot handle the weight of an SOP or the fragility of a senior citizen’s life, they certainly should n’t be handling the weight of administrating a nation or even a city.

A nation's strength is measured not by the ego of its administrators, but by their empathy and professional competence. We must now move beyond rhetoric and demand that these qualities become the baseline for public service.

Walaupun kes jenayah adalah keutamaan segera, ia juga menjadi asas untuk menuntut pertanggungjawaban daripada MBPJ dan pegawai yang terlibat atas tingkah laku "ala gangster" yang jelas terakam dalam rakaman CCTV.

  • Liabiliti Vikarius: MBPJ bertanggungjawab secara sah ke atas tindakan salah (Serangan, Pukulan, dan Kecuaian) kakitangan mereka semasa menjalankan tugas.
  • Salah Laku dalam Jawatan Awam (Misfeasance in Public Office): Berusaha untuk membuktikan pegawai tersebut bertindak dengan "niat jahat" atau melampaui kuasa sah dengan menggunakan alat penjerat haiwan sebagai senjata terhadap seorang warga emas.
  • Semakan Kehakiman: Memaksa MBPJ mendedahkan SOP, Rekod Latihan, dan Jadual Bertugas melalui proses "Penzahiran" (Discovery) atas arahan mahkamah.

  • Hak Pengenalan Diri: Pegawai mesti memberikan pengenalan diri dan menyatakan unit mereka.
  • Had Premis Persendirian: Kemasukan pihak berkuasa ke premis persendirian secara amnya memerlukan kebenaran khusus atau waran, melainkan terdapat ancaman serta-merta.
  • Kekerasan Berpatutan: Sebarang kekerasan fizikal yang digunakan mestilah benar-benar berpatutan. Penggunaan alat kawalan haiwan ke atas manusia adalah pelanggaran SOP yang amat berat.

 
Rancangan Semasa: Kewarasan lwn Ego
Keutamaan segera kami kekal pada Bahagian A: Mendapatkan DAA (Pelepasan Seolah-olah Pembebasan) daripada Peguam Negara dan Mahkamah. Kita sebenarnya sedang meminta negara untuk melakukan tindakan radikal iaitu: "jangan bersikap kejam" terhadap seorang mangsa strok berusia 71 tahun.

Sebaik sahaja Uncle Khoo selamat dari segi undang-undang daripada urusan sia-sia yang berlarutan lebih 1,000 hari ini, kita boleh beralih ke fasa akauntabiliti sivil. Jika pihak berkuasa merasakan proses mahkamah itu "meletihkan," mereka harus bersedia untuk alternatifnya: rakyat yang benar-benar tidak lupa. Jika sistem terus melindungi ego "ala gangster" berbanding maruah manusia, ubatnya mudah: Undi dengan bijak. Dalam Pilihan Raya Umum akan datang, mari kita simpan undi kita untuk mereka yang tahu membezakan "tadbir urus yang baik" daripada "ketidakadilan yang jahat." Jika mereka tidak mampu memikul beban sesuatu SOP atau kerapuhan nyawa seorang warga emas, mereka pastinya tidak layak memikul beban mentadbir sebuah negara, malah sebuah bandar sekalipun.

Kekuatan sesebuah negara tidak diukur melalui keangkuhan para pentadbirnya, sebaliknya melalui empati dan kecekapan profesional mereka. Kita kini perlu melangkau lebih daripada sekadar retorik dan menuntut agar kualiti-kualiti ini dijadikan piawaian asas dalam perkhidmatan awam.
