Stop the killing of an INNOCENT Wolfdog and FIRE JOHN BAIRD

The Issue

 

 

Mission : Free female Wolfdog “Briccs” and abolish code 604.06. Ohio revised code 604.06 states “Regardless of whether the owner, keeper, or harborer of a dog has been convicted of any offense which qualifies the dog as a level-one (1) or level-two (2) threat, the Animal Control Officer, Director of Public Health or Chief of Police may designate a dog as a level-one (1) or level-two (2) threat.” In other words, law enforcement has the power to designate your dog as a high level threat to the public “regardless of whether the owner, keeper, or harborer has been convicted of any offense”. This case and the city’s eagerness to file a “motion to destroy” Briccs is proof this law is an egregious miscarriage of justice. After hiring the necessary legal team and freeing Briccs, we will fight to abolish this unconstitutional law to absolve the possibility of it adversely impacting the lives of the innocent ever again.

On August 17th, 2023, Decardo March’s wolfdog, Briccs was violently taken by animal control in Cleveland, OH. The accusation was that she had attacked a woman who suffered serious injuries 2 weeks prior. Upon being made aware of these claims 2 weeks prior Decardo had informed the officers that not only did his dog have nothing to do with the alleged incident, but that he had video footage from that day showing she had been on her lead the entire day and night of the attack. Furthermore, he also informed police that his older brother witnessed the attack and was actually the one who took action (we know in 2024 most people would’ve just recorded the whole thing) and pulled the loose dog off the woman, though to no avail. A week before police came to our home and seized Briccs, the victim recanted her statement and admitted that Briccs was not the animal who attacked her. This didn’t stop local law enforcement from taking her anyway. Chief of animal control, John Baird has been a thorn in my family’s side in our attempt to get our dog back. Not only has he not come out and speak the truth, he’s continued to file baseless charges against my little brother while the case has been ongoing. News agencies in the area published stories claiming Briccs was a vicious wild animal who hunted down humans and was a danger to the community. Threats were made against her and my family saying they would kill her, and my home was vandalized on 3 separate occasions. The judicial process behind this case has produced a plethora of questions, yet no answers. The initial judge listed on the case was Michael Nelson, when De’cardo showed up to his 9am arraignment in Nelson’s courtroom it was empty. He called his attorney at the time, Mark several times who didn’t answer. Decardo then went to the clerk at the request of the bailiff to see if he had the correct information only to be sent back to Nelson’s courtroom. At around 12:30 pm he received a call from Mark saying he had a warrant for not showing up to court. Turns out judge Nelson was retired the whole time. That didn’t stop judge Michelle Earley from issuing a $500 warrant to Decardo for not showing up to court even though he literally showed up to court. We’re now 11 months into this case and we still do not have discovery or a trial date. Judge Michelle Earley recused herself from the case on 7/17/2024 without explanation. Jacob Margolis, the 3rd attorney Decardo has worked with since being charged, also withdrew from the case that very same day. Though Jacob was assigned to represent Decardo, his actions depict him as an extension of the prosecution. He routinely rejected Decardo’s demands to add the only other person who witnessed the attack to the witness list, withdrew a motion Decardo wanted to file to release Briccs, and made sure on every conversation to share with Decardo that the prosecution was willing to drop all fines, jail time, and restitution associated with this case if he just agrees to give up his dog. Now why would the city want to let a guy off the hook so easily whose animal caused such horrific injuries? Because they know she IS INNOCENT! The tactics being utilized by the City of Cleveland are absolutely disgusting and must be brought to the forefront so that they may be held accountable for their actions. 11 months into this case and my brother is still being hit with new charges (google the cuyahoga county municipal docket reference case numbers “2024-CRB-002975” and “2024-CRB-004035”) in an attempt to scare him into submission. The building located at 1200 Ontario where Decardo attends court is named the “Justice Center”. However the prosecution has provided anything but. To this day the animal responsible for this attack is still at large, the victim has changed her statement at least 3 times, and an innocent pack animal literally incapable of surviving in isolation remains in a cement cell, where she’s been for over 11 months for a crime all parties involved know she did not commit!

We are creating this petition to raise awareness about the illegal tactics being utilized by the City of Cleveland. The first phase of our campaign is to successfully free Briccs from her current state of confinement, then immediately after take the steps necessary to abolish the “right to destroy” an animal without cause in the state of Ohio. No one person should wield the power to legally kill your animal without cause. Abolishing this horrible statute will ensure that something like this can never happen to any other innocent animals. We are also looking to relocate Briccs and her family to a new, remote, wolf friendly community where her life will be cherished and never threatened again. Thank you for your time.
