The developer at Pennyfern failed to submit their Planning Application by the deadline date of the 28th December 2024.

The Town and Country Planning (Scotland) Act 1997

Proposal of Application Notice was valid on 28/06/23 and under the terms of Section 35B(3) of the Town and Country Planning (Scotland) Act 1997 (as amended) the planning application has to be submitted no later than 18 months from 28/06/23, otherwise the Notice lapses. The major planning application can be submitted up to 28/12/24 provided at least two public events have been carried out.

If the prospective developer/applicant does not intend to proceed with the development they do not have to withdraw the Proposal of Application Notice, rather it will lapse on 28/12/24.

Well, the 28th of December 2024 has come and gone.

This is a significant victory for our residents and community. Your voices have been heard, and your concerns have been taken into account. We have successfully prevented the construction of a development that would have had a detrimental impact on our neighbourhood and environment.

I want to extend our heartfelt gratitude to everyone involved in this fight. Your support, dedication, and unwavering determination have made all the difference.

IMPORTANT

While the threat of the BESS development has been lifted, we must remain vigilant.

Developers may attempt to submit new applications in the future.

We must continue to monitor the situation and be prepared to respond swiftly and accordingly.
