The Issue
The tragic incident that led to the premature and grievous loss of Benjamin Montalvo due to the actions of Noemi Velado, who was convicted of Vehicular Manslaughter with Gross Negligence and a Felony Hit and Run, should not be taken lightly. Neomi Velado was sentenced for her crime, yet the California Department of Corrections and Rehabilitation is releasing her after only serving 2.5 years of her 9 year sentence which carries a mandatory 5 years. This decision undermines the justice sought by the victim's family and threatens public safety by sending a message that such repeated reckless behavior bears minimal consequences.
Vehicular manslaughter is a grave offense, especially when compounded by Noemi Velado’s prior three hit-and-run incidents. The repeated nature of her offenses showcases a blatant disregard for the law and public safety, indicating a pattern of behavior that suggests she may pose a continued risk to society if released early. Studies have shown that recidivism rates tend to be higher for offenders with a history of repeated offenses, especially those involving reckless endangerment of public welfare.
To ensure justice is served and to protect the community from potential future harm, it is imperative to hold Noemi Velado accountable to the full extent of her original sentence. Justice is not only about punishment but also about deterring future crimes and ensuring public safety. By serving out her full sentence, Noemi Velado can demonstrate a genuine commitment to rehabilitation and understanding the severity of her actions.
We call upon the California Department of Corrections and Rehabilitation to revoke their decision to release Noemi Velado before she has fully served her sentence. By doing so, they would reaffirm their commitment to public safety and ensure that justice is served in its entirety for the victim and their family.
Sign this petition to urge the California Department of Corrections and Rehabilitation to reconsider their decision and ensure that Noemi Velado completes her original sentence without further reduction. Protect our community and advocate for the right to safe and just legal processes. Family outraged after suspect set for early release
