STOP SOBER ARREST & penalties OF DISMISSED/INNOCENT INDIVIDUALS & CASES
The Issue
My life has been turned upside down due to Senate Bill 34 in Oklahoma, which contains hidden loopholes and contradictions. This law mandates a chemical blood test if you're pulled over based purely on an officer's subjective opinion, without clear guidelines. I've faced this ordeal without causing harm, injury, or death, yet suffered immense personal and financial consequences. This law infringes on our Amendment Rights and invades personal privacy.
The State of Oklahoma seems to disregard the principle of "Innocent Until Proven Guilty," forcing individuals to bear the financial burden even after cases are dismissed. This often includes expenses for IDAP devices, mandatory classes and fees, and reinstatement of one's driver's license. It's unjust to punish individuals who have been proven innocent, undermining their lives with these extensive financial demands.
Consider these shocking numbers: between 2019 and 2021, nearly 15,000 reported cases of false DUI charges resulted in dismissed cases, yet individuals still faced financial penalties. The injustice isn't in the case alone, but in the aftermath where individuals are left to repair the damage done to their lives.
There are realistic and fair solutions. Firstly, the Oklahoma government must revise Senate Bill 34 to ensure the use of chemical tests is based on solid, unbiased procedures, with transparent guidelines and protections for individual rights. Additionally, the state should cover the financial costs incurred by individuals once they are proven innocent. A system must be in place to automatically remove financial penalties and fees for dismissed cases.
This isn't just about overturning unjust charges; it's about restoring dignity to the innocent. It's time to demand legislative change that respects citizens' rights and eliminates unjust penalties.
Sign this petition to advocate for a fair judicial process in Oklahoma and ensure that innocent citizens are no longer punished for crimes they did not commit. Together, we can push for legislative amendments that uphold justice and fairness for all.
