ATTENTION ADVOCATES: We have been receiving information that the Clemency Project 2014 committee has been getting back to individuals with stash-house sting cases, and treating each case differently. Individuals with the "Hobbs Act" robbery charge are being told that they do not meet the "non-violent" criteria for clemency, while those without that charge (who meet all the other criteria) are being appointed lawyers. After some research, we have found that the "Hobbs Act" statute itself (though it has elements of violence) is not in itself a violent crime if the defendants individual conduct was not violent. Meaning that it's the defendants individual conduct that determines if they are a "non-violent" offender, NOT the charging statute. So we want to conduct a "letter drive" asking Clemency Project 2014 to treat all fictitious stash-house sting cases equally, and to look into the defendants individual conduct rather than their charging statute when determining if they are "non-violent" offenders. So to all who have a fictional stash-house sting case, we need you to write a letter (and ask your supporters to write one on your behalf) asking Clemency Project 2014 to review your case file & individual conduct, and consider representing you for clemency. Our next "Post" on this matter will include a sample letter for you and your loved ones to build off of. But feel free to write your own version and send to the following address as soon as possible.
