STOP Retaliatory Housing Discrimination Against An Elderly Disabled Widow

The Issue

MiddleTown Property Group (a.k.a. MiddleTown Living) is retaliating against my elderly, disabled mother and attempting to force her out of her home.  Not only will that cause her immense physical and emotional distress—putting her life at grave risk—it will also cause her an incredible financial burden, forcing her to go thousands of dollars in debt to fund a forced relocation she not only doesn't want to make, but is terrified will kill her.  

My mother is a Ball State alum who graduated in the '70s.  She's lived on Bethel Ave, right on the edge of campus, for more than 30 years.  MiddleTown Property Group is not only trying to bully the elderly, disabled widow of a Vietnam Veteran out of her home, they're trying to bully her out of her hometown... where she's lived for longer than that company's owners and executives have been alive. 

What they're doing is morally reprehensible and legally indefensible.  It is retaliatory housing discrimination.  Formal complaints have been filed with the Indiana Civil Rights Commission and the United States Department of Housing and Urban Development.  Those investigations have not yet concluded.

MiddleTown Property Group was fined tens of thousands of dollars and placed "on probation" less than two years ago and are currently the subject of another year-long investigation by the Indiana Attorney General's office because of countless more complaints that have been filed over the past 12-18 months.

My mother is completely blind in one eye and suffers from debilitating heart & breathing problems that require her to use a walker, even to get around her own home.  Her current home checks off every box when it comes to the accommodations required, allowing her to navigate throughout the unit and access & maneuver in the kitchen and bathroom with ease.  

It has proven to be virtually impossible to find another unit that meets all her needs that is not also owned and/or managed by MiddleTown Property Group.  They own and/or manage thousands of units and have created a de facto housing monopoly on & around Ball State campus.  Even if we could find another apartment that meets all her needs, given the breakneck pace with which MiddleTown Property Group is acquiring property in this area, the odds of them buying whatever building she moves into are incredibly high.  What happens when they inevitably buy whatever building my mother moved into?  The nightmare would start all over again and they will force her to move... again.

If you're the parent of a college student or a teenager who soon will be, this is about much more than just one elderly, disabled widow.  This is also about stopping MiddleTown Property Group from preying on your kids, just like they've preyed on thousands of other innocent, vulnerable BSU students for years.  

Last July, MiddleTown Property Group's treatment of my mother became so egregious that it warranted a personal call from the Section Chief of the Attorney General's Homeowner Protection Unit to their counsel first thing on a Monday morning just to compel them to comply with the law and stop trying to force me to vacate, leaving my mother without the in-home assistance she needs.  If they're willing to do that to an elderly, disabled widow, just imagine what they're willing to do to college kids.

We have been waiting more than a year and a half for the outcome of the Attorney General's investigation into our complaint to decide what, if any, additional civil litigation would be necessary to keep my mother in her home.  We can no longer wait.  MiddleTown Property Group will force my mother out of her home in the next two weeks if we do not pursue legal action to stop them now.
