Thank you for signing my petition. By signing, you are sending a message to survivors of childhood sexual abuse that you are willing to listen and act when they break their silence. In India, when survivors break the silence even to their own family, the typical reaction is to minimize the crime and say “forget about it and get on with your life”. Most people find it uncomfortable and embarrassing and it is easier to brush it under the rug and pretend that it did not happen. Even if they believe it did happen, they try to convince themselves and the survivors that it was not a big deal. This gives the child molesters protection and confidence as they know they will rarely be challenged or ostracized from the family, even when they are found out. This reluctance extends to the judicial system in India. It took me over 20 years to find lawyers courageous and far-thinking enough to support me, and even now there is no success in filing my complaint. Although advocates and politicians suggest that current Indian Penal Code (IPC) provisions can be used, no one seems clear on how and when these might be used. For example, can IPC section “outraging the modesty of a woman” be invoked? Does this have a statute of limitations? Can the statute of limitations be challenged? Even the recent Protection of Children against Sexual Offences (POCSO) Act enacted in 2012 is unclear on procedures addressing complaints by adult survivors of childhood sexual abuse. The police are reluctant to act in the absence of clarity from the courts. The first step to success is to start the judicial debate. With your support, I feel we are on our way to success.
