Stop Ohio from Advertising Disabled People Online
The Issue
In Ohio, a county government employee can take a disabled person’s name, diagnosis, location, behaviors, weekly schedule, and the places they go, and send it to hundreds of home care companies statewide without the person’s consent, even over their written objection. The companies click “Interested” or “Not Interested.” Then they can see which disabled people got the most “Interested” clicks.
It's called the LiveCare Marketplace. It was developed by OnSeen Marketing, Inc., which received a $985,000 grant from the Ohio Department of Developmental Disabilities.
This system has it backward. The government should help people with disabilities find caregivers, not help strangers find people with disabilities.
People with disabilities are not products to be marketed. They are individuals with rights to privacy, dignity, and self-determination. They should not have to give up their personal and medical information to hundreds of strangers in order to receive Medicaid-funded services.
We demand that Ohio:
- Shut down the LiveCare Marketplace. County boards of developmental disabilities must stop creating and distributing advertisements of people with disabilities.
- Replace it with a provider marketplace. Qualified, vetted providers should advertise their services, qualifications, geographic service areas, staffing availability, and contact information, just as they do in any other healthcare setting. People with disabilities and their families should be able to browse available providers and choose whom to contact, not the other way around.
- Prohibit disclosures without consent. People with disabilities should decide what information to share directly with providers they choose to contact.
- Require accountability for past disclosures. Ohio must identify and notify affected individuals, provide complete disclosure records, investigate potential violations of confidentiality requirements, enforce applicable laws, and hold responsible parties accountable.
People with disabilities deserve privacy, dignity, and control over their own lives.
Sign this petition to demand that Ohio take down the LiveCare Marketplace and replace it with a marketplace where providers advertise themselves and where disabled people are the customers, not the product being advertised.
