Require Judicial Officers to Confirm Ex Parte Orders with Domestic Shelters

I believe that a significant change must be made in how judicial officers approve ex parte orders for protection. Adapting personal experience, my husband filed a fictitious ex parte order for protection alleging child abuse against me.  With no merit or validity to his claims, I have been separated no contact from my three daughters for 3 months without a hearing. Crow Wing County bureaucratic nightmare of process over people/children has caused more harm than anything else.

Ex parte protection orders are crucial to protect victims of domestic violence. However, there is a potential for misuse of these orders, allowing malicious individuals to further harm and control the victim, the partner attempting to separate from them. Therefore, we urge the law to require judicial officers to confirm ex parte orders with local domestic shelters. This step can ensure the petitioner isn't misusing the system for personal gain or to exert control over others.

In the United States alone, it is known that almost 20 people per minute are physically abused by an intimate partner (source: National Coalition Against Domestic Violence). Ex parte orders are designed to safeguard these victims. However, falsely accusing a party can ruin lives, separate families, and spread fear.

We must prevent the misuse of this system whilst still ensuring the protection of those truly in need. To maintain the balance of justice, we request that verification checks are implemented with local domestic shelters before ex-parte protection orders are approved.
