Petition to: City of Cape Town and Western Cape Government

Introduction
We, the undersigned residents and concerned members of the public, call on the City of Cape Town and the Western Cape Government to introduce a preventative regulatory requirement requiring an environmental noise impact assessment before the installation or significant modification of heavy industrial machinery in areas where industrial properties are located adjacent to residential communities.

The problem
Across Cape Town, industrial areas often border residential neighbourhoods.

While industrial and commercial activity is an important part of our economy, the installation of certain types of machinery — including large extraction systems, ventilation equipment, compressors, refrigeration systems, generators, and other heavy mechanical equipment — can create significant noise, vibration and environmental impacts.

Currently, residents are often only able to raise concerns after the equipment has already been installed and is operating.

This creates a reactive process:

Machinery installed → residents affected → complaints lodged → investigations conducted → mitigation attempted → possible enforcement action

This process can take months or even years, during which residents continue to experience the impact.

The proposed solution
We propose that where heavy machinery capable of generating significant noise or vibration is proposed for installation near residential areas, a prior assessment should be required.

Such an assessment should consider:

expected noise levels at nearby residential properties;
operating hours;
tonal and low-frequency noise;
vibration impacts where applicable;
cumulative impact from existing machinery;
required acoustic mitigation measures;
monitoring requirements.
Where risks are identified, appropriate mitigation should be implemented before the equipment becomes operational.

Why this change is needed
A preventative assessment process would benefit everyone:

Residents would have confidence that potential impacts are considered before they occur.

Businesses would have clarity regarding their obligations before investing in equipment.

Municipal authorities would reduce the burden of resolving disputes after problems have already developed.

A real-world example
Recent experiences in Cape Town residential communities have demonstrated the difficulty of resolving industrial noise issues after machinery has already been installed.

In one case, residents have spent more than a year engaging with authorities regarding noise from an industrial operation. The matter has required investigations, measurements, mitigation attempts, affidavits and ongoing municipal processes.

A separate recent example involving a newly established business has highlighted the same concern: large industrial ventilation equipment installed close to residential properties can immediately create conflict if potential impacts are not considered beforehand.

These examples are not about blaming individual businesses. They demonstrate a gap in the current system.

If a preventative assessment process had existed, potential impacts could have been identified and addressed before residents were affected.

Our request
We call on the City of Cape Town and the Western Cape Government to:

Review existing noise-control and planning regulations.
Identify gaps relating to the installation of high-impact industrial machinery near residential areas.
Introduce a requirement for environmental noise impact assessments where appropriate.
Require suitable mitigation measures before commissioning machinery likely to affect nearby residents.
Create a clearer preventative process that protects both communities and responsible businesses.
Our vision
We are not asking for industry to be prevented from operating near residential areas.

We are asking for responsible planning.

The goal should be:

Assess before installation.
Mitigate before operation.
Prevent conflict before communities suffer.
