Thank you to everyone who has stood behind this campaign — we’re at a critical moment, and your action now could make all the difference.

I have submitted a formal legal objection to the planning portal for Tamar Nurseries (Application Ref: 25/00436/FM). It outlines multiple serious breaches, including: 


❌ The developer is refusing a legal archaeological condition.
The Council has asked for a Written Scheme of Investigation to protect potential historic remains, but the applicant’s agent has refused. Under the law (Section 100ZA of the TCPA 1990), permission cannot be granted if this condition is rejected.

 
❌ The application misrepresents what’s already been built.
A huge 6,200 m² glasshouse — built in 2020 — is described as “proposed.” This is a clear breach of planning rules(Section 65 TCPA 1990) and deliberately hides the accurate scale of the site.

 
❌ The Environment Agency is investigating (Ref: GE41672).
There are 12.6 million litres of water storage, underground drainage systems, and no flood modelling — all in Flood Zone 3, and without proper permits or risk assessment.

 
🛑 A national planning loophole is being exploited.
By calling the site “self-contained,” the developer has managed to bypass all regulatory oversight — no enforcement from the Drainage Board, no consultation with the Lead Local Flood Authority, no EA permits. This isn’t just a local issue — it’s a systemic failure.

I object to application 25/00436/FM. The developer has refused a required archaeological condition, meaning the Council cannot legally approve the application. The site includes unauthorised infrastructure, no drainage plan, and is under Environment Agency investigation. It should be refused or called in for full review.
