      My name is Aleksey, I’m contacting you on the behalf of Russian speaking asylum seekers. We hope you or your organization can help us in the matter of things that are happening right now on United States' southern border with Mexico. U.S. Customs and Border Protection (CBP) started practicing detaining nearly every male adult from Russia, Uzbekistan, Tajikistan, Kazakhstan and Kyrgyzstan for an unknown cause.  

     Mass detention of Russian-speaking single male adults started on August 1, 2023. CBP aggravated the situation by September 1, 2023 and started detaining each male individual in a family unit despite having apostilled marriage certificate presented to CBP officers at the Ports of Entry. CBP officers disunite husband-wife families, proceed them as single adults and detain male individual on a regular basis. CBP officers also detain non-biological fathers in family units, thereby leaving mothers with one or more minors in extreme conditions without any assistance on U.S. soil.

     As of this point of time, 90 percent of male asylum seekers from above-stated counties are being held in custody without any justification. Those detained asylum seekers used the CBP One app to schedule a time and place to present themselves at a port of entry. On May 11, 2023 Department of Homeland Security (DHS) and the Department of Justice have issued a final rule to incentivize the use of lawful pathways. The final rule was designed to encourage migrants to use lawful, safe, and orderly processes for entering the United States. As a complement to this final rule, DHS has taken significant steps to expand safe and orderly pathways for migrants to lawfully enter the United States. This included: putting in place a mechanism for migrants to schedule a time and place to arrive in a safe, orderly, and lawful manner at ports of entry via use of the CBP One mobile app. Detentions are taking place despite people using a lawful method to cross the border and waiting for several months in unsafe areas of Mexico. CBP officials have the preliminary ability to request information and conduct checks on asylum seekers waiting to meet them. Meanwhile, the Latin American population crosses the border without problems on the same day. In the current situation, there is clear discrimination based on nationality.

     A similar thing also occurred to immigrants from Muslim countries who were far too frequently subjected to persecution and prison confinement. This information can easily be found by googling "U.S. probing prosecutions of migrants from Muslim-majority countries exposed by Times investigation”. While immigrants from Muslim and Latin American countries have human rights defenders on both sides of the border, problems of our tiny Russian speaking community have simply been slurred over. According to CBP statistics (https://www.cbp.gov/newsroom/stats/nationwide-encounters only 1.99 percent of total encounters were Russian speaking in 2023 (FYTD). Our community knows neither an organization nor a high-profile official who could help us elucidate this problem.

     The CBP One mobile app was created to establish a lawful pathway for individuals seeking asylum without the burden of arrest, except for valid reasons. While residents of other countries experience a fair system that allows them to freely go through CBP on the same day of their appointment, Russians and citizens of the aforementioned CIS countries are consistently subjected to mass arrests based solely on their nationality. Moreover, no explanations are provided for the cause of such discrimination. Within the Russian-speaking community, stories confirming this discrimination emerge daily.
The separation of family units has come as a surprise to many. At the current moment, officers do not even consider the presence of a marriage certificate for family units without children and family units where the father is not the biological parent. The overwhelming majority of these families have official marriages that are over a year old, and they share their lives and finances, all of which are integral parts of the family unit.

     Moreover, the mechanism for protecting family units with shared persecution cases is unclear. Serious problems arise in defending the case of the second family member of the primary applicant in the family unit. They are assigned a separate court. The question arises: how is the family member of the primary asylum applicant supposed to defend their case when the primary applicant is behind bars? According to the law, family members should be included in the asylum application of the primary applicant, and the practice of separating families is unacceptable.

     As the burden of proof lies with the asylum seeker, we consider it unjust that there is an absence of equality between a detained individual in detention and a free person among asylum seekers under the CBP ONE program. This inequality is evident in the fact that a free individual has a reasonable period to gather evidence for their asylum application, ranging from several months to several years depending on the state, in order to provide more comprehensive evidence to immigration officers and the asylum judge regarding their asylum claim.

     The majority of us fled from Russia literally with our passports in hand due to the immediate danger of imprisonment and are now forced to collect evidence within extremely tight timeframes. If an individual is alone and has no friends or relatives in the country they left behind, independent evidence gathering is nearly impossible. Asylum seekers are limited to one hour in the library and 12 phone calls per week without internet access. This is precisely why the statistics for denials of political asylum by courts within detention facilities are approximately 95%.

     The unqualified translation in detention centers is also a significant problem. Translators provided by CBP have been repeatedly reported for intentionally or unintentionally distorting information that can be legally significant during interviews, case preparation, or hearings.

     Many people suffer from health problems due to the impact of low temperatures from round-the-clock air conditioning, leading to cold-related illnesses and lung inflammation. There are known cases where diabetics are not allowed to take life-saving medications. General medical assistance is provided only after a long time and in the most extreme cases, and it is often of poor quality.

     Round-the-clock lighting, lack of windows, sleeping on the floor under foil blankets, absence of hot water, and pressure from officers - the items listed above can be equated to torture-like conditions of detention, even though these individuals have not actually violated the law. People who have illegally crossed the U.S.-Mexico land border without going through official ports of entry, bypassing the CBP One app, are held in similar conditions. In the current situation, the meaning of using the CBP One app for legal entry is lost when people who have not violated the law are detained as if they had breached the rules of entry and the law.

There are also known cases of detaining and placing elderly and disabled individuals in detention who do not pose a threat to the state. In the Russian-speaking community, there are constant reports of discrimination against Russians from the very beginning of crossing the border to being detained and held in custody. Despite positive interview results regarding credible fear, Russians continue to be held in detention centers, while representatives of other nationalities are released on the same day they receive a positive interview outcome. Officers themselves inform detainees that they have orders to detain and hold all Russians. There have already been cases of hunger strikes due to violations of basic human rights, but CBP employees threaten immediate deportation in response.
There is another significant issue related to the CBP One application system that we would like to shed light on. Specifically, there is widespread fraud occurring within the CBP One system, where many individuals are deceiving the system to gain an advantage in securing meeting dates at the southern border. They do this by creating additional forms with errors in their surnames, names, dates of birth, or passports. By adding forms with errors, the system fails to recognize that a person has already submitted an application for a meeting at the southern border. This has given rise to an entire market of fraudulent services for generating such additional forms.

     CBP officers are allowing these individuals with errors in their forms to cross the border, correcting the mistakes on the spot, treating them as equal participants. Many of these individuals have created over 200 forms and scheduled more than 200 meetings in a day, which essentially constitutes fraud. This situation has persisted for four months, and while it has been reported to CBP's security service, no significant measures have been taken to address it, apart from minor cleanups of multiple forms. We believe that one straightforward solution to this problem is to prohibit individuals with errors in their surnames, names, and dates of birth from crossing the border using CBP One forms.

     We believe that this situation has a negative impact on the U.S. economy because it hinders the integration of capable individuals into the U.S. workforce and the generation of additional tax revenues. Instead, funds from the U.S. budget are allocated to the maintenance of detention centers.

     Our Russian group lacks representatives in the public sphere, human rights activists, diaspora groups, or human rights organizations. We are ordinary individuals who have faced significant discrimination at the U.S. southern border based on our nationality, and we have been restricted in our ability to apply for and prove our right to political asylum.

     We request the dissemination of information regarding the described problem through the media. Additionally, we call upon all compassionate individuals to help address this situation of discrimination in accordance with U.S. laws.

Мы являемся частью большой группы русскоязычных просителей убежища и пишем Вам, чтобы сообщить, что у всех нас возникла большая проблема на сухопутной границе США с Мексикой. По неизвестной причине пограничная служба CBP начала задержание практически всех людей мужского пола из России, а также из Узбекистана, Таджикистана, Казахстана, и Киргизии.

С 1 августа 2023 года началось массовое задержание одиноких мужчин с последующим помещением их в detention центры, через месяц с 1 сентября 2023 года ситуация усугубилась, сотрудники CBP стали задерживать всех мужчин в составе family unit (несмотря на имеющиеся свидетельства о браке с апостилем), тем самым разделять семьи не имеющих детей и считать их как single person, так же стали задерживать мужчин не биологических отцов в составе family unit, тем самым оставляя матерей с одним или несколькими несовершеннолетними детьми в сложнейших условиях без необходимой помощи супруга на территории США.

На данный момент почти 90% лиц, просителей убежища-мужчины из указанных стран, содержатся под стражей без объяснения причин. Задержанные люди, как и мы используют разработанное DHS приложение CBP One, созданное для использования лицами просящими убежище, для обеспечения места в очереди на южной границе в соответствии с Новым правилом администрации президента Байдена о предоставлении убежища в котором указано, что человек не будет иметь право на получение убежища, если только он не въехал в Соединенные Штаты в официальном порту въезда после посещения встречи запланированной через CBP One. Задержания происходят несмотря на то, что люди использовали законный метод пересечения границы и ожидали несколько месяцев встречи на не безопасной территории Мексики и у сотрудников CBP есть предварительная возможность запросить данные и осуществить проверку ожидающих встречи просителей убежища при этом Латиноамериканское население переходит границу без проблем. В сложившейся ситуации прослеживается дискриминация по национальному признаку.

Аналогичная ситуация сложилась и с выходцами из мусульманских стран, которые также непропорционально часто подвергаются преследованиям и тюремному заключению. При этом не дается никаких разъяснений, в чем причина такой дискриминации. В русскоязычном комьюнити ежедневно появляются истории, подтверждающие дискриминацию.

Разделение family unit для многих стало неожиданностью, на текущий момент офицеры даже не смотрят на наличие свидетельства о браке не имеющих детей family unit и family unit в которых отец не является биологическим, у подавляющего большинства семей заключены официальные браки более года назад, имеется совместный быт и финансы, все это является неотъемлемой частью family unit. Так же непонятен механизм защиты family unit имеющих общее дело о преследовании. Возникают серьезные проблемы с защитой своего дела второго члена семьи основного заявителя family unit, ему назначается отдельный суд. Встает вопрос, каким образом должен защищать свое дело член семьи основного заявителя на убежище, в то время как основной заявитель находится за решеткой, практика разделения семей недопустима.

В связи с тем, что бремя доказывания лежит на просителе убежища, мы считаем не справедливым отсутствие равноправия у задержанного в detention и свободного человека среди просителей убежища по программе CBP ONE. Оно проявляется в том, что у свободного человека есть разумный срок сбора доказательств по его прошению убежища от нескольких месяцев до нескольких лет в зависимости от штата, для предоставления более полных доказательств дела иммиграционным офицерам и судье по своему прошению об убежище. Большинство из нас бежало из России буквально с паспортом в руках из-за непосредственной опасности оказаться в тюрьме и теперь вынуждено собирать доказательства в крайне сжатые сроки. Если человек одинок и у него нет друзей или родственников в стране, которую он покинул, самостоятельный сбор доказательств почти невозможен. Проситель убежища ограничен часом в библиотеке и 12 звонками в неделю без доступа к Интернету. Именно поэтому статистика отказов в политическом убежище судами на территории detention составляет порядка 95%.

Так же огромной проблемой является неквалифицированный перевод в detention центрах, переводчиков предоставляемых CBP, неоднократно сообщалось о намеренных или не намеренных искажениях информации, которая может быть юридически значимой в процессе интервью, подготовке дела или его слушанью.
Многие люди страдают от проблем со здоровьем из-за воздействия низких температур от круглосуточно работающих кондиционеров, что приводит простудным заболеваниям и воспалению легких. Известны случаи когда диабетикам не дают принимать жизненно важные препараты для здоровья. Общая медицинская помощь оказывается только спустя продолжительное время и в самых крайних случаях и часто является не квалифицированной.
Круглосуточно включенный свет, отсутствие окон, сон на полу под фольгой, отсутствие горячей воды, давление со стороны офицеров - перечисленное выше можно прировнять к пыточным условиям содержания под стражей, данные люди фактически не нарушали закон. В таких же условиях содержания находятся люди, незаконно пересекшие сухопутную границу США и Мексики минуя пункты перехода и приложение CBP One. В сложившейся ситуации теряется смысл перехода через приложение CBP One, если люди не нарушавших закон содержатся как нарушившие правила перехода и закон.

Так же известны случаи задержания и помещения в detention стариков и инвалидов, которые не представляют опасность для государства. В русскоязычном комьюнити постоянно всплывают сообщения о дискриминации Россиян от самого начала прохождения границы до помещения и содержания Россиян под стражей, несмотря на положительные решения по интервью на достоверный страх, Россиян продолжают держать в detention центрах, когда представители других национальностей выходят на свободу в день получения положительного результата на интервью. Сами офицеры сообщают задержанным, что у них приказ задерживать и держать всех Россиян. Уже известны случаи объявления голодовки в связи с нарушениями элементарных прав человека, однако, сотрудники CBP на это угрожают немедленной депортацией.
Существует еще одна большая проблема касающаяся приложения CBP One на которую мы бы хотели пролить свет, в частности это мошенничество в самой системе CBP One, множество людей обманывает систему и получает преимущество в получении даты встречи на южной границе, путем создания дополнительных анкет с ошибками в фамилии, имени, дате рождения или паспорте.Таким образом добавляя формы с ошибками система не видит того, что человек уже подал заявку на встречу на южной границе-это порождает целый рынок мошеннических услуг по созданию такого рода дополнительных форм.
А офицеры CBP пропускаю таких людей через границу с ошибками в form, исправляя ошибки на месте, как равноправных участников, хотя многие из них создавали более 200 form и назначали более 200 встреч в день, что по своей сути является мошенничеством, данная ситуация продолжается уже четыре месяца, об этом сообщалось в службу безопасности CBP, но кроме небольших зачисток мульти-анкет, никаких мер принято не было. Одно из простых решений данной проблемы мы считаем запрет перехода людей с ошибками в фамилии, имени, дате рождения - в анкетах CBP One.
Мы считаем, что данная ситуация оказывает негативное влияние на экономику США, потому что препятствует вливанию и адаптации работоспособных людей в экономику США и получению дополнительных доходов в бюджет от налогов, а вместо этого из бюджета США выделяются средства на содержание в Detention центрах.

У нашей Российской группы нет представителей в публичном пространстве, правозащитников, диаспоры, правозащитных организаций. Мы обычные люди, которые столкнулись с серьезной дискриминации на южной границе США по национальному признаку и оказались ограниченными в праве подать прошение и доказать свое право на политическое убежище.
