Dear Supporter I have received a letter from the Information Commissioners Office, responding to my complaint about the Home Office's failure to comply with my FOI request. They have written to the Home Office instructing them to respond. 26 June 2018 Case Reference Number FS50758163 Dear Ms Holbourne Your ref: Windrush Information request to the Home Office Thank you for your correspondence of 20 June 2018 in which you complain about the time taken by the above public authority to carry out its public interest test. Where a public authority requires any additional time to consider the public interest, they must respond within 20 working days of the request. That response must state the exemption(s) being considered and must include an estimate of the time by which this decision will be made. The Commissioner considers that public authorities should aim to respond fully to all requests within 20 working days. In cases where the public interest considerations are exceptionally complex it may be reasonable to take longer but, in our view, in no case should the total time exceed 40 working days. I have written to the Home Office and instructed them to respond to you within 10 working days from the date of receipt of our letter, that is, by close of business on 10 July 2018. If no response is provided within that timeframe, a decision notice obliging the Home Office to respond to your request will be issued. If the Home Office responds and you are not satisfied you should contact them again to request an internal review. Should you remain dissatisfied after exhausting any internal complaints process then you may complain to us again. At this stage we will require a copy of the Home Office’s response, your request for an internal review and the outcome. I hope this information is helpful.
