Steven Avery’s current post conviction petition is before the Wisconsin Court of Appeal and a decision is expected soon.

Steven is appealing against the lower court’s ruling that dismissed his newly discovered evidence & Brady violations.  Steven’s lawyer Kathleen Zellner, argues that the lower court failed to properly assess the post conviction petition based on statute & case law. 

The essence of the Appeal is that new evidence has come to hand proving Teresa Halbach left the property in her car, contrary to the prosecution’s narrative and that Law Enforcement knowingly failed to advise Steven’s defense team of these facts. A witness has come forward confirming that he saw the car being pushed onto the Avery Salvage Yard property in the early hours of Saturday 5th of November 2005, only hours before it was ‘discovered’ mysteriously by a search team.

Zellner is seeking a statutory evidentiary hearing to examine in court this new evidence with a view to being granted a new trial!  More to come soon!
