The Issue

The state of Maryland has four degrees of burglary charges. 1st, 2nd and 3rd degree are all felony charges and are eligible to be expunged after 10 and 15 years respectively. The only misdemeanor, 4th degree, is not eligible to be expunged ever. Thousands of honest, hard working citizens have been and continue to be affected over this inexplicable legislative oversight. Fourth degree burglary is usually nothing more than a trumped up trespassing charge, and at a time where a simple petty citation could be issued, the state will arrest and charge you, leaving a permanent record that can never be expunged. At a time when judicial reform is at an all time necessity, this is a small step we need to take to begin allowing much positive change.

Why would the state willingly expunge a first degree felony but not a fourth degree misdemeanor? Make it make sense...demand answers!!
